About this file

This is a Justification for Other Than Full and Open Competition (J&A) document prepared by the U.S. Immigration and Customs Enforcement (ICE) Office of Acquisition Management for a one-month contract extension under the noncompetitive procedures authority of 41 U.S.C. §3304(a)(2) (Unusual and Compelling Urgency).

The procurement extends an existing hybrid contract with Salus Worldwide Solutions Corp for Operational Support Aircraft Maintenance (OSAM) services on a Government-Owned, Contractor-Operated (GOCO) C-37B Gulfstream 650ER aircraft. The extension period runs from July 30, 2026, through August 27, 2026, with an estimated total value of $1,379,332.76 for the base period. Contract line item numbers (CLINs) include Fixed Maintenance Oversight ($126,138.21), Maintenance Flight Hour ($36,000.00), Other Direct Costs ($436,900.00), and Fixed Ownership Amounts ($780,294.55). Funding is provided through ICE Operations and Support (OB3) appropriation for Fiscal Year 2026. The contractor will provide routine and non-routine maintenance, airworthiness support, aircraft readiness activities, maintenance coordination, and limited flight activities necessary to maintain the aircraft in a mission-ready condition. The justification cites unusual and compelling urgency arising from the U.S. President's declaration of a national emergency regarding dangerous illegal aliens and the critical operational needs of the Enforcement, Removals, and Operations Division. The incumbent contractor is uniquely positioned to provide immediate support without risking aircraft airworthiness, as transition to another vendor would introduce unacceptable delays during a period of heightened homeland security demands. Market research identified approximately 16 potential vendors; however, the accelerated timeline and specialized maintenance requirements preclude full and open competition. The contracting officer certified that anticipated costs are fair and reasonable based on rates already established under the existing contract.
