About this file
This is a Memorandum for Record documenting justification and approval for a sole-source contract modification with an unnamed contractor to provide surge Base Life Support (BLS) services in Panama.
The Department of the Army, through the 410th Contracting Support Brigade, is modifying contract PAN410-26-P-0000 025420 to increase pricing for surge Contract Line Item (CLIN) 0013. The modification supports the Joint Security Cooperation Group – Panama (JSCG-P) at Cristobal Colon, Panama, providing BLS services for 150 military personnel beginning no later than 25 September 2026. The original contract, awarded 03 July 2026, initially supported the Jungle Operations Training Course – Panama (JOTC-P) with surge capacity for the PANAMAX exercise. In early September 2026, the United States Army Western Hemisphere Command (USAWHC) assumed a new operation requiring continuous monthly surge capacity over ten months of the remaining fiscal year. The surge pricing modification increases total contract value by 9.9%, with specific cost drivers including ten additional months of continuous services such as tents, generators, supplies, latrines, showers, handwash stations, black/gray water removal, air conditioning, maintenance, laundry services, and labor. Additional cost increases result from global market pressures affecting fuel rates in Panama due to international conflicts and rising crude oil costs. The contracting officer determined that only the incumbent vendor can meet the 25 September 2026 mobilization requirement due to established personnel and equipment on-site, existing logistical supply chain networks, Panamanian environmental clearances for wastewater management, and pre-approved subcontractor base access—factors that would pose significant risk if a new vendor were engaged within the compressed timeline.

MEMORANDUM FOR RECORD
SUBJECT: JUSTIFICATION AND APPROVAL – ONLY ONE RESPONSIBLE SOURCE
1. Description. Surge of Base Life Support (BLS) Services for the Joint Security Cooperation Group – Panama (JSCG-P), Contract , PAN410-26- P-0000 025420.
2. Statutory Authority. 10 U.S.C. 3204(a)(1) or 41 U.S.C. 3304(a)(1). FAR Authority.
6.103-1 only one responsible source and no other supplies or services will satisfy agency requirements.
3. Supporting Evidence. On 03 July 2026, a contract was awarded to provide base life support (BLS) services at Cristobol Colon, Panama for 150 students attending the Jungle Operations Training Course – Panama (JOTC-P). The contract included two surge contract line items (CLIN) that were in support of a two-month annual PANAMAX exercise. During early September, the United States Army Western Hemisphere Command (USAWHC) assumed a new operation requiring a monthly surge of 150 military personnel at Cristobol Colon, Panama. The monthly and annual cost for surging increased for the surge CLIN 0013. The new operation requires the first surge of personnel to begin no later than 25 September 2026. The current CLIN 0013 surge pricing provides a monthly amount of and an annual amount of when leveraged for a two-month PANAMAX exercise event. Considering a continuous monthly surge supporting 150 personnel over ten months of the remaining base year, the price per month for is with a ten-month amount of
(including fuel and a phase-in mobilization cost). The new CLIN 0013 surge prices are reasonable compared to the IGCE and published market prices. Based on vendor quotes and the Independent Government Estimates (IGCE) for this requirement, the cost for providing BLS services for 150 personnel for twelve months is
, which reflects the current effort supporting BLS services to the Jungle Operations Training Course – Panama (JOTC-P). Specific elements contributing to the increased cost on the BLS surge CLIN 0013 include ten additional months of continuous services to include tents, generators, supplies, latrines, showers, handwash

Contracting Officer stations, black/gray water removal, air conditioning, maintenance, laundry services and labor. Additionally, due to global market pressures in Panama, fuel rates have trended upward due to conflicts involving Iran and rising international crude oil costs. As a result of the new cost for the ten-month surge, a modification is required to increase the surge pricing for CLIN 0013. Considering the increase in the surge CLIN 0013 costs, the total contract value including the base and all option years, increased by from to which is a 9.9% increase.
4. Finding/Rationale. Only one source can satisfy this requirement to provide a monthly surge of BLS services by 25 September 2026. During the initial contract award on 03 July 2026, each vendor submitted technical plans regarding their mobilization timeline. I reviewed these technical plans, specifically for their ability to mobilize to the same LSA location and for a similar personnel requirement (150) personnel). I also analyzed these technical plans against the realities on the ground in Panama. The awardee, , already has the required personnel, equipment, and logistical supply chain network to provide surge BLS services within the prescribed timeline. The ability of other vendors to establish BLS services at Cristobol Colon by 25 September 2026 is strained due to the various factors attached to vendor limited transportation routes, adherence to environmental standards, and the clearance process for approving subcontractor access on base. All these factors would pose significant risk to mobilization and establishment of all BLS services in time by leveraging a new vendor. The current vendor, , is the only vendor with an established route for providing personnel and equipment on-site at Cristobol Colon for BLS services. Additionally, is the only known vendor who has presently cleared Panamanian environmental standards for wastewater management and obtained base clearance and access for all their subcontractors to provide BLS services onsite. Based on my experience as the Contracting Officer administering this contract, and the Contracting Officer primarily in charge of contracting in the Panama region, mobilization by 25 September 2026 is only possible with . This vendor has already established and cleared the above-mentioned hurdles.
5. Determination. is the only responsible source that can meet the requirement to surge base life support (BLS) services monthly for 150 personnel starting 25 September 2026 in support of the Joint Security Cooperation Group – Panama (JSCG-P) at Cristobal Colon, Panama. As a result, a bilateral modification should be issued to adjust the pricing for the surge CLIN 0013.
