About this file

This document is a Justification and Approval (J&A) for the use of other than full and open competition to award a firm fixed-price contract to RBR Ltd, a large business, for an RBRconcerto3 C.T.D. deep sensor device.

The Naval Supply Systems Command Fleet Logistics Center Jacksonville is acquiring the deep-water CTD device to support the Naval Postgraduate School (NPS) Physics department curriculum in Monterey, CA. NPS currently has two identical RBR deep-water CTDs and requires a third of the same type for long-term data collection. The justification cites the need for compatibility with existing software and instrumentation, as well as the importance of data quality and consistency for student thesis research and scientific studies. The total estimated cost is $9,961.11, with an 8-10 week delivery timeline. The acquisition will be made using the commercial items exception under FAR 13.501(a).

Navy Marine Corps Acquisition Regulation Supplement APRIL 2018 (Change 18-24)

ANNEX 1 – JUSTIFICATION AND APPROVAL

J&A No. 24-J037

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Supply Systems Command Fleet Logistics Center Jacksonville

2. Description of the Action Being Approved.

Award of a firm fixed-priced contract on a sole-source basis to RBR LTD (RBR), a large business, for an RBRconcerto3 C.T.D. deep sensor device. Part Number L3-M13-BEC11- SCT110-SP11. The device supports Naval Postgraduate School (NPS) Physics department curriculum in Monterey, CA.

3. Description of Supplies/Services.

The RBR deep-water CTD will record oceanographic data in support of our acoustic data collection in various field tests. The instrument will be deployed in waters up to 6000m deep.

The total estimate for this acquisition material and delivery is $10,908.00 based on RBR quote Q-45638 dated 03 JUN 2024 that expired on 01 SEP 2024. On 29 AUG 2024, the Contract Specialist called RBR and obtained a revised quote for $9,961.11.

The estimated delivery data (EDD) is 8-10 weeks after receipt of order (ARO).

Payment will be made from NPS’s Government Purchase Card (GPC) cardholder.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The Statutory authority permitting an Other than Full and Open Competition for this requirement is 41 U.S.C. 1901(e)(2), Special Rules for Commercial Items. This sole source acquisition will be implemented by Federal Acquisition Regulation (FAR) 13.501(a), Sole Source Acquisitions.

5. Rationale Justifying Use of Cited Statutory Authority.

A deep-water CTD (an oceanographic instrument that measures conductivity, temperature and depth) is required to measure acoustic environment in the vicinity of our deep-water acoustic recorders. The highest quality data will result in the highest quality research results from our students and faculty. NPS currently have two identical RBR deep-water CTDs in our inventory and require an additional one of the same type to be placed on a third mooring for long term data collection. This is being sought from the manufacturer of the instrument since the parts and software need to be compatible with the existing software running the instrument. Using an identical instrument as the others allows us to use the same software to process the data and allows us to have the instruments calibrated by the same company using the same methods which is critical to the quality of the data collected during the experiments. Using an instrument built by another manufacturer adds uncertainty to the data collected during the experiment, rendering the results of the study less useful for student thesis research (NPS primary mission) and to the scientific community as a whole which is unacceptable for a leading graduate research university like NPS.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In accordance with FAR 6.302-3(a)(2)(ii), Full and open competition need not be provided for when it is necessary to award the contract to a particular source or sources in order to establish or maintain an essential engineering, research, or development capability to be provided by an educational or other nonprofit institution or a federally funded research and development center.
