JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304

Title: Noritsu Printers – QSS Series Date: 07/21/2021 Estimated Contract Dollar Value:
1. Identification of the agency and the contracting activity.
The U.S. Department of Justice (DOJ), Federal Bureau of Investigation (FBI), Information Technology Acquisition Unit (ITAU) has prepared this “sole source” justification for other than full and open competition for Noritsu Printers on behalf of the Photography Program/Training Division.
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
It is the intent of the DNA Photography Program/Training Division to acquire a firm fixed price delivery order for Noritsu QSS printers and warranty services. This purchase that will be a sole source to Noritsu America Corporation. This is a one-time hardware and warranty service request.
3. A description of the supplies or services required to meet the agency’s needs.
The requirement is for two (2) brand name Noritsu QSS Green line printers. In February of this year, two of the current Noritsu D703 printers reached 12 years of usage. When discussing production times, the printers currently can average anywhere from 200-250 prints (8x10) per hour using roll paper. Unfortunately, only one of the printers is currently working. The exact printer that is currently out of service is the same one that was serviced less than 6 months ago. It would be cost effective to update the printers now because of their age and the amount of prints that are provided to all the surrounding divisions in the area. The Photo program provides prints to several units like, CIRG, OTD, Lab, TD, JEH/HQ, and most of the 56 field offices who are represented at the FBI Academy for training purposes (pre-COVID-19 era). The printers are primarily utilized at Building 9, Upper Level, Room B221, 57 Bureau Pkwy Stafford, VA 22556.
4. The statutory authority permitting other than full and open competition.
For purposes of this acquisition, the statutory authority permitting other than full and open competition is delineated at 41 U.S.C. 3304 (a) (1) and implemented at FAR Part 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
Market research demonstrated that there are no authorized resellers. Noritsu America Corporation is the sole provider of Noritsu QSS-Green line printers. This equipment matches the exact capabilities of the Noritsu D703 printers that are currently being utilized. The Training Unit considered the Epson SureColor P900 17-Inch printer which retails around $1,399 but, it does not have the ability to print multiple sheets in a continuous motion like the Noritsu D703. Also, the Epson SureColor P900 Printer would work if the workload was light. However, the Basic Field Training Course (BFTC) requests countless projects that depend on a fully operational industrial strength printer. The unit have processed 200–300-page print outs request at one time. The proficiency and quality in print that the Noritsu QSS Green line printers can provide is both efficient and consistent with the current required output. It would be economically unsound to switch to another brand of printer especially since the same ink cartridges and rolls of paper which the FBI has already spent $1000’s procuring is compatible with the Noritsu QSS Green line brand, making the transition from utilizing the D703 to employing the Noritsu QSS Green line seamless and cost effective for the FBI.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The FBI publicized this requirement on the Federal Business Opportunities website. This announcement gave an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of technical capabilities and cost information. No other vendors expressed interest.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer (CO) from the Federal Bureau of Justice (FBI) will determine fair and reasonable pricing at the Delivery Order (DO) level based on the specifics of the requirement. Various price analysis techniques to include, but not limited to adequate price competition, comparison with historical pricing, and available commercial price list will be utilized. In addition, the CO will seek additional discounts at the DO level.
8. A description of the market research conducted and the results.
A synopsis was posted on the Federal Business Opportunities website. This synopsis gave an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of technical capabilities and cost information. No other vendors expressed interest.
9. Any other facts supporting the use of other than full and open competition.
The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
10. A listing of any sources that expressed a written interest in the acquisition.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
None, this is a one-time acquisition.
