Eustis-2015-17
Justification and Approval for Other Than Full and Open Competition
Contracting Activity: Mission and Installation Contracting Command (MICC) – Fort Eustis
1. Description of Action: The nature of this action is to serve as a transition from the current contract with Cubic Applications, Inc. (contract number W911S0-11-C-0015) to the follow-on task order under the Army Capabilities Integration Center (ARCIC) Multiple Award Task Order Contract (MATOC). This approval is for a modification to an existing firm-fixed priced contract for 45-days that will use FY16 OMA funds. This action is estimated at $ .
2. Description of Supplies/Services: The contractor will be required to perform the administrative and planning tasks currently performed on the existing contract. Support encompasses administrative, planning, and production support for 45-days and a single UQ event associated with the Future Study Plan (FSP). FSP support will begin with planning and preparation based on the Government objectives for the next year that result from Government review and analysis of the recently completed studies together with guidance from the Army Chief of Staff, CG TRADOC and Director, ARCIC. The contractor will also support the production of plans and planning artifacts needed to produce the Program of Execution (POE).
The POE is used as the base document for the Government developed FSP describing the responsibilities and requirements of the various Government and non-Government organizations participating in game preparation and execution, and providing scenario development, blue and red campaign planning, administrative and logistics, computer and audio-visual, and technical support for the game. The primary tasks are separated into the following categories and subcategories:
a. Event Coordination.
1) Program of Execution
2) Structure
3) Schedule
b. Pre-Event Administration.
1) Assessor Training
2) Obtain Venues
3) Event Briefings
4) Invitations
c. Event Execution.
1) Modeling & Simulations Tool
2) Support materials
3) Equipment (incl. A/V, Reproduction etc.)
4) Billeting
5) Parking
6) Execution of enabling events
7) Message Center
8) Track Participant Status
9) Security Verification
10) Visitor Bureau
d. Post-Event Administration.
1) After Action Review Input
2) Event Summaries
e. Integration.
1) On-site Support
2) Admin. Web Page
3) Status Reports
4) Achieves Information
Each primary task consists of subtasks that are necessary to successfully execute each UQ event.
The Independent Government Estimate concluded this 45-day extension would cost $ to include travel and ODCs.
FAR Clause 52.217-8, Option to Extend Services, allows for “continued performance of any services within the limits and at the rates specified in the contract.” This clause was included and evaluated prior to the award of the existing contract that has since undergone PWS changes that required a revised price proposal. This clause only allows for an extension of the services, unchanged and at the same price. Therefore, this clause no longer remains relevant to this requirement and cannot be used for this action.
3. Authority Cited: This action is authorized under provisions of 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements.
4. Reason for Authority Cited: This extension requirement is necessary for the successful transition of the follow-on task order. The Request for Task Order Proposal for the follow-on task order has already been solicited and the ARCIC MATOC vendors have a current due date of 14 September 2015. This extension will allow the Government to shift the start date from the first day of the fiscal year to 15 November. A 1 October start date presents inherent risks to the Government and Contractor due to the possible absence of an appropriation or Continuing Resolution. This extension would not only alleviate this risk, but it would also allow for a 15-day phase-in period on the new task order that is currently unable to be factored in to the timeline due to funding constraints. The Government will be able to include a phase-in period to assist with a seamless transition from the current requirement to the requirement that has been developed over the last 4 years. The requirement naturally goes through shifts in focus and has matured over the duration of the period of performance of the last contract since the Future Warfare Division is the organization within ARCIC that focuses on the future state of the Army. The combination of an extension with a phase-in period will allow the Contractor on the new task order to become familiar with the requirement and allow the necessary amount of time to become accommodated with the FY16 requirement.
Alternatives considered by the Government consisted of:
(a) Forgo Services: Forgoing services was not a feasible solution due to the Chief of Staff of the Army’s mission to execute the Future Study Plan/Unified Quest, in which event planning and execution usually occur within the first month of the fiscal year. Not having any support would either delay the Plan by pushing all the events back or the Plan’s goals would not have been met creating a ripple effect of failed missions. Furthermore, Government resources are not sufficient to accomplish these tasks.
(b) Expedite the new task order award and eliminate the phase-in period: This was also not a viable solution as the Government assumes the risk for expediting proposal submission periods and evaluation. The proposal submission and technical evaluation should be commensurate with the level of complexity of the requirement. UQ Support consists of various levels of different events, advanced design of the program as well as each event, integration of all each event and its outcome, preparation and execution of events, and post-event analysis and reporting. The Government would cause undue risk on itself by hindering this critical part of the Source Selection Process and would open itself to a protest. Eliminating a phase-in period would be detrimental to the Future Warfare Division due to the significant changes in the requirement over the past four years. It is highly likely a turbulent transition would result from the removal of a phase-in period, which would severely impact the UQ schedule.
5. Efforts to Obtain Competition: The effort to obtain competition is currently being sought on the ARCIC MATOC for the new task order. The ARCIC MATOC consists of three capable vendors – Booz Allen Hamilton, Inc., Cubic Applications, Inc., and JANUS Research Technologies, Inc. Each of these vendors have submitted a subcontracting plan under the initial award of the MATOC and are expected to provide a subcontracting plan for each task order.
6. Actions to Increase Competition: Currently, this action is required to be competed amongst the contractors under the ARCIC MATOC as this is an ARCIC requirement.
7. Market Research: Market research was performed in accordance with FAR Part 10 and conducted appropriate to circumstances. There are multiple vendors that are capable of providing these services; however, the ARCIC MATOC is the intended way forward for the FWD UQ requirement.
8. Interested Sources: To date, no other sources have written to express an interest besides the ARCIC MATOC vendors. Industry has been aware of ARCIC requirements falling under the ARCIC MATOC since April 2013.
9. Other Facts:
(a) Procurement history. The FSP/UQ support services requirement has two (2) known previous contracts. In 2006, Booz Allen Hamilton was awarded contract number W912SU-06-C-0006, which consisted of a 3-month base period and four (4) 12-month option periods. This contract was solicited as an unrestricted requirement. The current contract was also solicited as unrestricted to procure these identical services and used lowest price technically acceptable source selection procedures.
(b) Other facts. Currently, Cubic is performing the tasks identified in paragraph 3 and a University Affiliated Research Center (UARC) (contract number W9113M-09-D-0001-0056) is performing the design, analytical, and reporting also required with Unified Quest Support. The Contracting Office responsible for this action did not get this award into place until 10 November 2014, therefore the current UARC UQ support contract expires 9 November 2015.
Extending the current Cubic contract 45-days would better align the expiration of the both contracts and would serve as a dual phase-in period to allow the new task order to begin full performance beginning on 15 November 2015.
