About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition to award a contract to Battelle Memorial Institute for engineering services in support of the Fleet Ballistic Missile (FBM) Program. The contract will provide services in the areas of structural material investigations, system dynamics and mechanics, manufacturing technology and product assurance, and support for design reviews and technical problem resolution. The proposed contract has a one-year base period and four one-year option periods, with an estimated total value of $11,975,514. Battelle is the only source that possesses the specialized knowledge and expertise required to perform this work, which includes in-depth understanding of the Trident II FBM system and components. Transitioning to another contractor would result in significant cost and schedule impacts due to the extensive training and qualification required.
The related federal contract opportunity is a pre-solicitation notice for a sole-source contract with Battelle Memorial Institute to provide engineering and program management services supporting the Trident II facility operations, D5LE2 missile production and planning, D5LE-2 missile technologies, and flight test support. The contract will have a one-year base period with four option years. SSP intends to award this contract using the authority of 10 U.S.C. 3204(a)(1) due to Battelle's unique expertise and qualifications.

The contemplated contract is expected to include a one-year base period and four one-year option periods. Performance is anticipated to begin on 29 November 2024 and end on 28 November 2029.
The estimated value of the contract is $11,975,514, inclusive of all option line items, as detailed in the chart below.
Appropriation FY25-FY29
OM&N $2,813,000
WPN $9,162,514
Total $11,975,514
Note: The contract will include a special contract term, which applies only to Level-of- Effort (LOE) line items, intended to provide a vehicle for the Government to acquire additional man-hours for work within the scope of the contract. This optional term allows an increase not to exceed 30 percent of the total value associated with each LOE contract line item to accommodate for emergent in-scope requirements. This increase of not to exceed 30 percent for LOE line items is not included in the total value in the above table.
4. Statutory Authority Permitting Other Than Full and Open Competition. 10 U.S.C. 3204 (a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority. The incumbent contractor, Battelle, is the only contractor that possesses the knowledge and expertise to perform the covered by this J&A.
To perform the required scope, a contractor must possess the following:
(1) Detailed knowledge of the ability to evaluate materials, engineering design, performance and failure analyses in areas of propulsion, missile control, missile structure, and missile support and transportation systems in support of the evaluation of the deployed D5 Missile system.
(2) The ability to perform material failure analyses and mechanical systems investigation in the areas of composite materials, metallurgy, elastomers, ceramic materials, structural adhesives, refractory materials, high speed rotating equipment related to solid propulsion, control system environments, and coatings applied to FBM systems.
(3) Detailed knowledge of dynamic and mechanistic performance for the propulsion subsystem, missile subsystem, and transportation equipment used in the D5 program to include evaluations of deployed Missile system extended life spans. This includes areas such as tribology, vibration and acoustic behavior, ordnance system and missile interaction, and railroad and highway vehicle dynamics.
(4) Detailed knowledge of the deployed D5 missile system, including ordnance and separation subsystems, missile control subsystem, missile components, propulsion components, and surface support equipment as well as the ability to analyze these systems and components to support investigations with testing, manufacturing and processing problems.
(5) The ability to perform analysis for Structures, Avionics, and Test Missile Kit (TMK), and complete manufacturing studies for those systems.
(6) The ability to assess and evaluate materials, engineering design, performance and analyses in areas of propulsion, missile control, missile structure, and production/manufacturing systems during the D5LE2 alteration.
(7) In-depth knowledge of the D5LE2 alteration and the ability to incorporate innovative production techniques, updated analyses techniques, and modern quality assurance techniques that will be evaluated in support of major milestone reviews such as Missile Subsystem Systems Requirements Review/Systems Design Review (SRR/SDR).
Battelle, possessing all of the above capabilities, which it has acquired through more than 60 years of work on the FBM program, is the only source that can develop and deliver the requisite engineering systems required for SSP. Their structural, mechanical, materials, and manufacturing technology and expertise has been applied to the Polaris, Poseidon, and Trident I and II FBM systems, the submarines that carry them, and their machinery and support systems. Beyond this, Battelle has other advanced technology capabilities that can be applied to support SSP, and their broad and deep expertise enables them to develop unique capabilities in response to the FBM program needs.
Battelle currently serves as a trusted advisor to SSP, often collaborating closely with FBM contractor, Lockheed Martin Space (LMS), and its subcontractors. The cost and delay associated with obtaining competition through qualification of an alternate source far outweigh any price, quality, or schedule benefits that can be reasonably anticipated from competition. In selecting another contractor to perform this work, the Government would encounter substantial, unrecoverable duplication of cost.
To quantify those costs, the SSP Program Manager for missile structures determined the expertise and infrastructure needed to perform the work required by using contractual/work history for TRIDENT II. Through this review, SSP determined that selection of another source would require the Government to incur additional training and development costs, as well as costs associated with qualifying another contractor. It is anticipated that these costs would total in excess of $12M. If selected, another contractor would cause detrimental delays in the readiness of the Fleet. It would take a minimum of five to seven years to transition to a new contracted source as this ongoing effort is evaluating previously performed efforts. Any delay in qualifying another contractor would directly impact the ability to successfully sustain capabilities across the existing Fleet and further delay ongoing development, production, and installation of developed and emerging capabilities which would adversely affect Fleet readiness and national security.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
a. Market research was conducted in accordance with Federal Acquisition Regulation Part 10.
Research techniques included: applying personal knowledge in procuring services of this type, contacting knowledgeable individuals in Government and industry regarding market capabilities to meet requirements, reviewing the results of recent market research undertaken to meet similar requirements, and querying the government-wide database of contracts at various Government and commercial websites. The conclusion reached was that:
1) Potential offers did not have the requisite experience and necessary capabilities to adequately address the specific and unique FBM engineering services without introducing both unacceptable risk to FBM requirements and costs to the program.
2) Competition and potential transition of remaining engineering services during the proposed contract period of performance would introduce significant impacts to D5LE2 alterations and unacceptable risk to the program.
b. Additionally, SSP posted a Sources Sought Notice on the SAM website on 20 March 2024.
Only Battelle expressed an interest in this requirement.
3) Determination of Fair and Reasonable Cost. The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
4) Actions to Remove Barriers to Future Competition. SSP will continue to monitor the market in an attempt to identify potential sources of these supplies and services for future requirements, while analyzing any potential impact to cost, schedule, and program risk. Additionally, the prime contractor for this effort will continue to utilize competition, compete suppliers and commercial item procurements where feasible for component parts. As this is a follow-on for supplies and services previously awarded on a non-competitive basis. In accordance with DFARS PGI 206.304(a)(S-70)(i), the prior J&A was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
