JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The requiring activity is U. S. Naval Forces Europe and Africa / U. S. Sixth Fleet (NAVEUR-NAVAF-SIXTHFLT) Naples, Italy. The contracting activity is NAVSUP Fleet Logistics Center Sigonella (FLCSI) Site Naples.

2. Description of the Action Being Approved.

Approval is sought to modify existing firm-fixed-price contract N6817122P0181 with Singularity Security Group LLC (Singularity) for additional Construction Surveillance Technicians (CSTs) and Cleared American Guards (CAGs) to provide adequate construction security and surveillance services to support the increase to the scope of work of the secure construction renovation project onboard Naval Support Activity (NSA) Naples, Italy in accordance with the Intelligence Community Directive (ICD) 705 and Department of Defense (DoD) policies. The construction work is being performed by a contract awarded by Naval Facilities Engineering Command (NAVFAC).

The need for the additional personnel will be for a total duration of nine months.

3. Description of Supplies/Services.

Contract N6817122P0181 is summarized as follows:

The requirement, as awarded, consists of the following staff:

(a) CST – Shall be US citizen with Top Secret clearance. Must have at least five (5) years of construction experience. Security experience may supplement up to two (2) years of construction experience if the security experience is directly related to SCIF construction or physical security. Must be familiar with the sixteen (16) standard divisions of construction. All CST personnel MUST have construction experience in addition to CST, CAG, or Military experience. All CSTs must hold a valid certificate for the successful completion of a Forty (40) Hour or greater accredited CST training course. Must be able to stand, sit, bend, walk, kneel, and perform other related physical activities for long periods of time. Must have experience implementing and complying with the ICD/ICS-705 (version September 10th, 2015).

(b) CAG – Shall be US citizen with Secret clearance. Must have at least two (2) years of security/access control experience. Must hold a valid certificate for the completion of a CAG course or similar training certification.

The CAG must be able to stand, sit, bend, walk, kneel, and perform other related physical activities for long periods of time.

The need for the additional CST and CAG support was identified in February 2023. In order for personnel to be on-site in July of 2023, the contractor needs approximately four to six weeks to complete the visa and personnel accreditation processes required to deploy US citizens to Italy. There is insufficient time between identification of this requirement until personnel need to be on site to solicit a competitive requirement, evaluate, and award a new contract. Also, the short duration of the need for increased number of personnel is expected to preclude competition.

The additional CST and CAG categories are within the scope of the basic contract. Because Singularity is the incumbent contractor, it has the personnel resources within its company staff to meet this requirement. Singularity also has the management in place to complete the visa and personnel accreditation processes for additional staff.

The current Singularity contract is already registered in the European Contractor Online Processing System that facilitates the personnel accreditation process, which will help ensure that required personnel are in place in July of 2023. The additional personnel will seamlessly integrate into the existing Singularity on-site management and leadership structure, rather than having to duplicate efforts with another contractor.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The contracting officer posted a synopsis of the intended modification to the Government-wide point of entry, the System for Award Management website, on 10 April 2023. The synopsis stated that the Government intended to solicit and only negotiate with a single source, Singularity, pursuant to the authority cited in paragraph 4. The contracting officer received no responses resulting from the synopsis.

The contracting officer did not conduct market research to identify additional sources to meet this requirement. The relatively short duration of these specialized services in an overseas location, the short turn-around time needed to have the personnel in place, and the continuity of management for the personnel accreditation process necessitate contracting with a single source. Also, the basic contract was awarded in June 2022, less than a year ago, and the results of the previous market research are current. Conducting a new competition is not expected to yield new sources to meet this requirement. The services are specialized, the vendor pool is small, and Singularity was selected as the best value contractor that quoted the lowest price to meet the requirement.

7. Determination of Fair and Reasonable Cost.

The contracting officer has determined that the anticipated cost to the Government of the additional personnel covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSUP FLCSI has no plans at this time to compete future contracts for the personnel covered by this document.
