About this file

This document is a justification and approval for using other than full and open competition to award a basic ordering agreement for US Navy Virginia Class Submarine emergency diesel generator global repair services. The agreement will be awarded on a sole source basis to Caterpillar, Inc. as the original equipment manufacturer and designer of the generators. The Naval Sea Systems Command requires the contractor to provide technical support, coordinate repairs, and supply parts for Caterpillar engines used in the diesel generators. Repair services are needed for scheduled maintenance, possible failures, and emergent repairs to return disabled generators to service quickly. Only Caterpillar has the proprietary knowledge, experience, facilities, and technical data required as the OEM to perform repairs and identify and correct nonconformances that cannot be identified through Navy documentation. The ordering period will be 60 months from award with a minimum period of performance of 72 months, and the total estimated value is $19,482,693 using an estimated 48,932 labor hours. The justification cites only one responsible source as the statutory authority.

J&A Number: 0231-23-067-00

The Governments minimum needs have been verified by the certifying technical and requirements personnel.

MOPAS Acquisition Strategy Plan # 0231-23-068-00 covers this acquisition.

Budgeted funds will include FY23-28 Operation & Maintenance, Navy (OM&N) funding. The total estimated dollar value of the proposed acquisition is $19,482,693. This is based on an estimated 48,932 labor-hours of services. The ordering period for this effort will be 60 months after the date of award with a 72-month Period of Performance (PoP) minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(a)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

CAT is the designer and Original Equipment Manufacturer (OEM) for the required Submarine EDG equipment and is the only contractor with the requisite knowledge, experience, facilities, and proprietary technical data necessary to provide the required services. CAT provides proprietary global repair services and aftermarket parts support for this equipment throughout its lifecycle. In cases of submarine diesel engine repairs resulting from equipment or component failure, OEM proprietary procedures and technical data are required to fully determine the root cause of the failure and the extent of repairs required. OEM proprietary procedures are required to identify and correct non-conformances that cannot be identified with existing Navy technical documentation. Only CAT can execute repairs required to effectively and rapidly return EDGs

CAT . In this case, technicians are required to be certified as CAT 3512B master mechanics. The training and certification these individuals receive, coupled with their access to proprietary repair procedures, techniques, tools and technical information, is what makes CAT field services personnel uniquely qualified to perform the required tasks. CAT does not offer this training and certification to non-certified CAT employees.

OEM parts must be used, throughout the execution of the above services, to ensure proper manufacture, fit, function, operation, longevity, and reliability. Since all of this information is proprietary, OEM parts are considered proprietary and not available from sources other than CAT. CAT is the sole owner of the rights to the proprietary design, fabrication, and assembly drawings that support this equipment. Finally, the company is the sole owner of proprietary processes and procedures for the fabrication of engine parts, systems and sub-systems, as well as the sole owner of proprietary processes and procedures for the accomplishment of critical maintenance and repair actions.

J&A Number: 0231-23-067-00

8. Actions to Remove Barriers to Future Competition.

The circumstances surrounding the need to obtain the required supplies/services without providing full and open competition will be reviewed annually by the Contracting Officer.

Orders will only be placed to support US Navy Virginia Class Submarine EDG global repair services provided by CAT. NSWCPD will continue to monitor the marketplace and identify potential sources of the services identified in this Justification. Any sources discovered that can potentially satisfy this specific procurement will be taken into account for any future requirements.
