DEPARTMENT OF THE NAVY
NAVAL SURFACE WARFARE CENTER
CORONA DIVISION
PO BOX 5000
CORONA, CA 92878-5000
IN REPLY REFER TO
J&A No. 50,177 Ser 02/2931
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 02.
2. Description of the Action Being Approved
Award of a Firm-Fixed-Price, Indefinite Delivery Indefinite Quantity contract on a sole source basis to Fluke Electronics Corporation (Fluke) for the purchase of Fluke Automated Pressure Calibrator (APC) upgrades part number (P/N) 4322A. Authority to act under this J&A shall be effective from the date of approval to the end of the contract term.
3. Description of Supplies/Services
The Naval Air Systems Command (NAVAIR) Metrology and Calibration (METCAL) Program has a requirement for up to a maximum of 254 APC upgrades, P/N 4322A to support Naval Aviation Fleet Intermediate Calibration Activities, Fleet Training Activities, and Navy Calibration Laboratories. The Fluke APC upgrades will be procured over a five-year ordering period.
The total estimated value of this acquisition is and will be funded with Aircraft Procurement, Navy (APN) funds. The table below depicts the type of funding as well as the estimated amount per fiscal year.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
Ser 02/2931
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements as implemented by Federal Acquisition Regulation (FAR) 6.302- 1(a)(2).
5. Rationale Justifying Use of Cited Statutory Authority
NAVAIR METCAL currently utilizes the Fluke APC P/N 4322 in over 730 annual calibration workload hours in support of intermediate-level calibration laboratories ashore and afloat.
The Fluke APC P/N 4322A is the only existing APC that works in the existing NAVAIR METCAL infrastructure, and will be used as a direct replacement to the Fluke P/N 4322, which has lost functionality due to broken and aging internal components. The Fluke APC P/N 4322A is the only commercially available unit that contains two (2) integrated and interchangeable contamination prevention systems (CPS), managed by a control unit. The Fluke APC P/N 4322A has a CPS with the ability to generate to the required 600 PSI with no external pressure supply or intensifier for onsite calibration capability. This pressure requirement is required to support onsite test requirements for NAVY operations.
Currently, NAVAIR METCAL has 81 Instrument Calibration Procedures (ICPs) written for the Fluke P/N 4322. Since NAVAIR METCAL is procuring upgrades to the existing Fluke P/N 4322, current ICPs will be revised rather than re-written. The estimated cost to revise the current ICPs is ( Per ICP X 81 ICPs). The estimated cost to re-write ICPs for a unit other than the Fluke P/N 4322A would cost up to ( per ICP X 81 ICPs). Thus, the difference between revising the current ICPs and having to re-write the ICPs if an alternative APC other than the Fluke P/N 4322A was procured is
( cost to re-write the ICPs less the cost to revise the ICPs).
In addition to the cost to re-write the ICPs if an APC other than the Fluke P/N 4322A were procured, a loss of time to fielding would occur within the fleet. Each pressure measurement ICP would take up to four (4) months to progress
Ser 02/2931 from start to issuance, with only two (2) ICPs being created concurrently by no more than two (2) engineers for a particular model number. Preparing for fielding an alternative APC will add a minimum delay of 162 months (4 months X 81 ICPs X 0.5 engineers). Fleet impacts will include a loss of pressure calibration capability for pressure gauges, transducers, transmitters and switches at several fleet calibration labs causing the removal of flight line support equipment required for daily servicing aircraft. By contrast, it would only take up to one (1) month per ICP or 40.5 months to revise all ICPs in the current NAVAIR METCAL inventory (1 month X 81 ICPs X 0.5 engineers). In addition, the Fluke P/N 4322A will be in use while ICP revisions occur, therefore not causing any additional delay in the fielding of these units.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research was conducted to determine if an APC capable of meeting the Government’s requirement was available in the commercial marketplace. Market research using web-based searches including GSA Advantage, Google, Bing, and NAVICPmart did not reveal any sources for the requested equipment other than Fluke, the original equipment manufacturer. The market research that was conducted revealed that Fluke produced the only APC capable of meeting the Government’s minimum requirements.
A Sources Sought Notice (SSN) was posted on the Beta.Sam website, indicating the Government’s intent to sole source this requirement to Fluke. The posting was issued on 9 April 2020 and closed on 24 April 2020. No responses were received at the close of the SSN.
Additional market research was conducted to verify if Fluke has authorized distributors or resellers with the ability to provide the Fluke P/N 4322A. An email was sent to Fluke on 30 April 2020 requesting information on any authorized distributors or resellers with the ability to produce the Fluke P/N 4322A. An email response was received on 1 May 2020 verifying that Fluke works directly with the Department of Defense and does not have authorized distributors or resellers with the ability to provide the Fluke P/N 4322A.

7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the items covered by this J&A will be fair and reasonable. The Contracting Officer will use price analysis, including commercial price lists and historical information to determine that the final price to the Government is fair and reasonable.
8. Actions to Remove Barriers to Future Competition
For the reasons set forth in Paragraph 5, Corona Division has no plans at this time to compete future requirements for the types of supplies covered by this document. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
