About this file

This justification and approval document outlines a limited source solicitation for refurbished steam turbine parts to support the overhaul of ship service turbine generators onboard two AS-39 Class vessels for the Department of the Navy's Military Sealift Command. The solicitation seeks quotes for various refurbished turbine parts including bearings, gears, diaphragms, valves and other components from the original equipment manufacturer Curtiss-Wright or two other sources recognized by MSC as having access to necessary technical data by April 13, 2022. The justification cites the proprietary data rights of the OEM and safety considerations as rationale for limiting competition to these three sources under the authority of 10 U.S.C. 3204(a)(1).

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 3204(a)(1) Only

One Responsible Source or Limited Number of Responsible Sources and no other type of property or service will satisfy the needs of the agency.

5. Rationale Justifying Use of Cited Authority: There are currently two active AS-39 Class Vessel’s in the

MSC Fleet; each vessel has Four Ship Service Turbine Generators (SSTG) onboard. The Original

Equipment Manufacturer (OEM) is Delaval Corporation (now Curtiss-Wright) owns the proprietary drawings, technical manuals and design information for the SSTG Steam Turbines and Reduction Gears onboard the AS-39 Class Vessels. The information is available to limited sources outside of Curtiss-Wright and this information is required to provide Technical Support and Replacement Parts for the SSTG Steam Turbines and Reduction Gears onboard. MSC N7 Engineering Director has officially recognized MI-Tech Inc. and PJ Schwalbenberg as sources also having access to the required technical documentation, knowledge, experience and tooling to accomplish the requirements.

Safety Management System (SMS) Procedure 10.6-002-ALL list the SSTG’s as Critical Equipment.

COMSCINST4490.1B requires work accomplished on this equipment be done by the OEM or an MSC N7 Engineering Director recognized repair facility capable of accomplishing the repairs. The three companies listed in Paragraph 3 are either the OEM (Curtiss-Wright) or have been evaluated and received a letter (MI- Tech & PJ Schwalbenberg) from the MSC N7 Engineering Director stating that they possess the required special knowledge, experience, special tooling and access to proprietary technical documentation necessary to accomplish this type of work.

Failure of one SSTG will result in the loss of Electrical Power Generation Capacity or Redundancy. The loss of two SSTG’s puts the vessel in a C-3 CASREP status, thus reducing its ability to perform its primary mission. Proper refurbishment and maintenance of the SSTG’s is critical to the safe operation of the AS-39 Class Vessels.

MSC does not own the proprietary technical data rights to this equipment onboard the AS-39 Class Vessels.

MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The sources sought for the proposed purchase order was posted on the SAM.gov website on April 6, 2022, and closed April 13, 2022, with two responses from MI-Tech and Curtiss-Wright, both indicating their respective companies are capable of providing the parts for this requirement. MSC perpetually seeks submissions from non-OEM contractors for consideration of qualification of their parts and/or services as an acceptable alternative to the OEM at https://www.msc.usff.navy.mil/Business-Opportunities/Contracts/Qualification-for-Items-Critical-to-Shipboard-Safety-on-MSC-Vessels/. The Government intends to post a combined synopsis and solicitation notice along with this justification at the Government Point of Entry with the intent of awarding a firm-fixed-price purchase order to the lowest price technically acceptable quoter.

7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable IAW FAR 13.106-3(a).

8. Actions to Removed Barriers to Future Competition: For reasons set forth in paragraph 5, MSC has no plans at this time to allow for non-OEM suppliers in future contracts or purchase orders for the types of supplies covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
