About this file

This is a Justification for Other Than Full & Open Competition (J&A) prepared by the Department of the Navy, NAVSUP WSS in Philadelphia for contract action Folder #25057-0038.

The Navy seeks to procure spares for various naval equipment through a non-competitive acquisition with an expected final delivery date of September 4, 2026. The acquisition is based on the statutory authority of 10 USC 3204(A)(1), which permits procurement from limited sources when only one or a limited number of responsible sources can satisfy agency requirements, as implemented under FAR 6.302-1. The contracting activity cites two primary rationales: (1) A/RMC 3,4 authority, which applies when acquiring directly from the actual manufacturer due to insufficient data, and (2) A/RMSC H.R authority, which applies when the Government lacks possession of sufficient, accurate, or legible data to purchase from other sources. The Navy has determined that the only source with the required technical data is the original manufacturer, and that due to program restraints or lifecycle considerations, it would be uneconomical to pursue competitive alternatives. No previous J&A was awarded under the Small Acquisition Threshold. Market research was conducted via posting on the government-wide point of entry on October 15, 2025, resulting in no additional offerors expressing interest. The contracting officer has determined the anticipated cost to be fair and reasonable. Multiple personnel across requirements, technical, KO review, legal, and competition advocacy functions have reviewed and approved the J&A, with final approval provided by the FAR 6.304 Competition Advocate on November 13, 2025.
