4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority for this effort is 10 U.S.C 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
a. GDEB has been building submarines for over a century and has been the construction activity and sole design agent for the Navy's ship submersible ballistic missile submarines (SSBNs) and corresponding shipboard support systems since 1959. Based on this experience, GDEB was designated as the SSBN Ship Design Agent (SDA) for the CLB by the Department of the Navy’s Naval Sea Systems Command (NAVSEA). The Navy has invested billions of dollars over the past 50 years to sustain GDEB's shipbuilding and shipboard systems support capabilities which has provided GDEB with decades of inherent knowledge, experience, and expertise in all facets of SSBN ship design, development, construction, maintenance, and corresponding training requirements for SSBN crews.
b. Development and integration of the CLB Class submarine trainer requirements and development and fabrication of the hardware being procured can only be obtained from a contractor with specialized ship design knowledge of the CLB Class submarine and access to the existing CLB Class submarine supply chain. As the Navy’s SDA for the CLB Class platform, only GDEB possesses the requisite knowledge, skill, subject matter expertise, and CLB unique supply chain infrastructure to perform these requirements.
c. It is further noted that GDEB has designed, procured, manufactured, installed, and tested the CLB Class SWSS to be utilized at the SWS Ashore Training Facility in Cape Canaveral, Florida. GDEB was also the lead construction yard for construction of a lead ship Missile Tube Module, design aspects of which will be used in the SWTS. Additionally, as identified in paragraph 5.a. above, GDEB has been designated as the CLB SDA and in this role is responsible for providing OHIO and CLB class ship design support.
d. Due to the highly technical requirements of this procurement and the required integration of SSBN SWSS with the specialized training requirements and CLB Class ship design, only GDEB, as the CLB SDA, can perform these requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
a. A Sources Sought Notice (SSN) was posted on the Government Point of Entry, beta.SAM.gov to solicit potential companies capable of performing these CLB Kings Bay Trainer System requirements. Only one SSN response was received from GDEB. GDEB provided a thorough and complete White Paper capability statement response which identified how they meet the minimum qualifications and experience requirements identified in the SSN as well as a detailed outline of their technical capabilities in relation to the published statement of work requirements. SSP’s technical expert conducted a detailed analysis of the GDEB White Paper capability statement and determined that GDEB is fully capable of performing these CLB Kings Bay Trainer System requirements.
b. SSP will continue to explore opportunities for competition. However, at this time and based on the market research and rationale identified in paragraph 5 above, SSP concludes that no other company other than GDEB can provide the required CLB Kings Bay Trainer System requirements identified in this J&A.
7. Determination of Fair and Reasonable Cost. A determination of fair and reasonable price will be based on a technical evaluation of the proposal, a detailed price analysis utilizing audit and field recommendations, and previous cost history and actuals, where appropriate. This is considered sufficient to allow the Contracting Officer to determine a fair and reasonable price for this acquisition.
8. Actions to Remove Barriers to Future Competition. For the reasons set forth in paragraph 5 of this document, SSP has no plans at this time to compete this contract for the types of supplies and services covered by this document. If another potential source emerges or is developed by Navy in the shipbuilding industry base, SSP will assess whether competition for further requirements is feasible.
