JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency:

The U.S. Army Corps of Engineers, Vicksburg District Contracting Office, 4155 Clay Street, Vicksburg, MS 39183-3435.

2. Description of Actions:

This requirement is being procured as a sole source to H&H Marine Services (CAGE Code: 3REL9) for the maintenance on the Motor Vessel (M/V) Sanderford to overhaul two Caterpillar C12 main propulsion engines (port and starboard) along with a rebuild of the port Twin Disc transmission. All work shall be performed within Caterpillar and Twin Disc specifications. The estimated value for this requirement is $111,511.36. The purchase request and certification (PR&C) number is W807PM00494840 and utilizes revolving Mississippi River and Tributaries (MR&T) funding. The period of performance is for work to be completed by 27 March 2020.

3. Description of Supply/Services:

The Dredging Section of the River Operations Division of the U.S. Army Corps of Engineers Vicksburg District has a requirement for the maintenance of the M/V Sanderford for the overhaul of two Caterpillar C12 main propulsion engines (port and starboard) along with a rebuild of the port Twin Disc transmission.

The overhaul of the two Caterpillar C12 main propulsion engines shall be performed within Caterpillar specifications. Manufacture specifications for the Caterpillar C12 main propulsion engines require all replacement or remanufactured parts be genuine new Caterpillar parts or Caterpillar remanufactured parts. The overhauls shall be completed by certified Caterpillar technicians in a Caterpillar certified shop. The contractor is required to perform the removal and re-installation of the two Caterpillar C12 main propulsion engines on the M/V Sanderford.

The overhaul of the Twin Disc transmission shall be performed within Twin Disc specifications. Manufacture specifications for the Twin Disc transmission require all replacement or remanufactured parts be genuine new Twin Disc or Twin Disc remanufactured parts. The contractor is required to perform the removal and re-installation of the Twin Disc transmission on the M/V Sanderford.

4. Authority Cited:

Authority permitting other than full and open competition for this requirement is 10 U.S.C. §2304(c)(2) as implemented by FAR 13.106-1(b)(1)(i) and 13.106-1(b)(1)(ii).

5. Reason for Authority Cited:

FAR 13.106-1(b)(1)(i) is cited based on the urgency of this requirement. This is an urgent requirement that became known during February 2020. The M/V Sanderford is scheduled to leave the Vicksburg Harbor during April 2020 to support MVK’s dredging operations. This requirement must be completed on or before 27 March 2020. Failure to complete this requirement on or before 27 March 2020 will delay MVK’s scheduled dredging operations. MVK’s dredging operations on the Mississippi River include maintaining a navigable channel for commercial navigation to move unimpeded. These operations are critical to maintaining navigation on the Mississippi River.

FAR 13.106-1(b)(1)(ii) is cited based on the brand name restrictions of this requirement. For the Caterpillar C12 main propulsion engine requirement, it has been determined to be in the best interest of the Government to require overhauls be completed by certified Caterpillar technicians in a Caterpillar certified shop and all replacement or remanufactured parts must be genuine new Caterpillar Parts or Caterpillar remanufactured parts. For the Twin Disc transmission overhaul, it has been determined to be in the best interest of the Government to require overhauls be completed by certified Twin Disc technicians in a Twin Disc certified shop and all replacement or remanufactured parts must be genuine new Twin Disc parts or Twin Disc remanufactured parts. These determinations are based on compliance with manufactured specifications; there are no known reasons to deviate from the manufacturers specifications.

The contractor is required to perform the removal and re-installation of the equipment on the M/V Sanderford. The contractor must be located near the Vicksburg, MS area so that this requirement will not experience a delay to transport the M/V Sanderford’s engines and transmission to and from a contractor’s facility. The costs to transport the M/V Sanderford’s engines and transmission to an area outside of the Vicksburg, MS Harbor is estimated at $8,000 - $10,000 per day of transportation. H&H Marine Services has been identified as the only source local to Vicksburg, MS that can support this urgent requirement. Any other potential source will require expending considerable funds on transportation.

H&H Marine Services is located in Vicksburg, MS and has the expertise to complete this requirement on or before 27 March 2020. There are no other known sources in the Vicksburg area with the expertise to support this requirement.

6. Efforts to Obtain Competition:

Market research determined that H&H Marine Services is the practical source located in the Vicksburg area that can support this urgent requirement. The compelling urgency of this requirement precludes competition to the maximum extent practical. In accordance with FAR 5.202(a)(2), this requirement will not be synopsized to the Government Point of Entry, https://beta.sam.gov/.

7. Actions to Increase Competition:

Market research was utilized and determined that competition could not practically be increased.
