About this file

This document is a Justification and Approval (J&A) for the use of other than full and open competition for the procurement of Structural Repair Composite Tool Sets, Part Number 3156AS100-1 on a sole-source basis from the Original Equipment Manufacturer United Drill Bushing Corporation.

The J&A authorizes a three-year, fixed-price Indefinite Delivery/Indefinite Quantity (IDIQ) contract with a contract minimum quantity of seven sets and an estimated total quantity of 15 sets, with an estimated total value. United Drill Bushing Corporation is the only firm with the required knowledge, expertise, and proprietary data to meet the quality requirements for structurally sound repairs of critical aircraft components. Fielding an alternate source would require new and costly engineering, integration, design, and testing efforts. The Government does not have sufficient engineering data or drawings to enable a competitive procurement. A market research through an RFI and pre-solicitation synopsis did not identify any other capable sources. The Contracting Officer has determined the anticipated cost to be fair and reasonable.

JOINT BASE MDL NEW JERSEY 08733

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ.

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves the issuance of a three-year, fixed-price Indefinite Delivery/Indefinite Quantity (IDIQ) type contract on a sole source basis to the Original Equipment Manufacturer United Drill Bushing Corporation, CAGE: 52369 for the manufacturing and delivery of Structural Repair Composite Tool Sets, Part Number (P/N)

3156AS100-1. Delivery orders will be issued on a Firm Fixed-Price basis.

3. Description of Supplies/Services.

A requirement exists for MQ-4C Triton Unmanned Air Systems Program in support of the

United States Navy and Royal Australian Air Force to perform structurally sound repair of critical aircraft components. The Structural Repair Composite Tool Set is required to support the repairs, as it is used to repair damaged aerospace composites on the aircraft. This three-year

IDIQ will have a contract minimum quantity of seven sets with a contract estimated quantity of

15 sets. The total estimated value is based on an estimated quantity of 15 sets.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

United Drill Bushing Corporation is the only firm with the knowledge of the Structural Repair

Composite Tool Set included components, tooling, and devices and the only firm with the expertise required to meet quality requirements for structurally sound repair of critical aircraft components. United Drill Bushing developed these units per Navy specification, and conducted, and completed contractor testing under the original contract, N68335-01-C-0020 that was competed as a small business set-aside. The testing addressed functional, environmental and safety aspects due to the health and safety hazards posed by the machining of composite structures. United Drill Bushing’s knowledge, therefore, extends to the integration and performance capabilities of the Structural Repair Composite Tool Set. United Drill Bushing does not have any authorized distributors.

Fielding different models of the Structural Repair Composite Tool Set would require new and costly engineering, integration, design and testing efforts to satisfy both Department of Defense and MQ-4C Triton requirements. If an alternate source is to manufacture the Structural Repair

Composite Tool Sets, they will have to undergo Navy testing due to the criticality of the structural repairs achieved through the use of the components/tooling/devices in the kit. If the

Government procured the Structural Repair Composite Tool Set from any other source, it’s anticipated that the Government would incur duplication of costs estimated at

In addition, the

Government does not own the item drawings, the United Drill Bushing is unwilling to sell the drawings and proprietary data for this requirement to the Government, and the Government doesn’t have sufficient engineering data or drawings to organically design the above items to enable a competitive procurement. Any procurement delays will negatively affect mission readiness and capability due to an unacceptable loss of maintenance capability to the MQ-4C platform.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market research was conducted in accordance with FAR Part 10 by the NAWCAD Lakehurst

Technical Team to ascertain what contractors were capable of providing the Structural Repair

Composite Tool Set. Efforts consisted of various searches by part number, National Item

Identification Number, and nomenclature via the Federal Procurement Data System – Next

Generation, the Dynamic Small Business website and Google. The Request for Information

(RFI) notice required by DFARS PGI 206.302-1(d), was published on the System for Award

Management (SAM.gov) website on 13 June 2024. One vendor responded to the RFI with a generic statement of interest but did not provide any information that indicated specific interest or capability to satisfy this requirement. A pre-solicitation synopsis, as required by FAR 5.201, was posted to SAM.gov on 1 July 2024. No responses were received.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAWC-AD LKE has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAWC-AD LKE will assess whether competition for future requirements is feasible.
