About this file
This document is a Sole Source Justification for a fiber optic installation project at the Military Ocean Terminal at Sunny Point (MOTSU) in North Carolina. The U.S. Army Corps of Engineers, Wilmington District intends to award a sole source contract to Pegasus Professional Services, LLC, a Veteran-Owned Small Business, to furnish and install approximately 1,500 feet of 12-strand fiber optic cable between two buildings at MOTSU.
The justification cites Pegasus's unique experience and knowledge of the existing wiring configuration and physical environment at MOTSU, which will allow them to complete the work more efficiently than another contractor. The estimated cost for the project is $17,000. This sole source award is being made under the simplified acquisition procedures of FAR Part 13, as the total value does not exceed the $250,000 threshold. The contracting office will continue to conduct market research to identify other potential providers for future fiber optic installation requirements at MOTSU.

SINGLE SOURCE JUSTIFICATION (Including Brand Name) Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $250K)
1. Contracting Activity: USACE-CESAW
US Army Corps of Engineers Wilmington District Contracting Division 69 Darlington Avenue Wilmington, NC 28403
2. Description of Action: This action is for fiber optic installation from Building 17 to Building 3 at the Military Ocean Terminal at Sunny Point (MOTSU), NC.
Nature: X New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number
Pricing: X Firm-Fixed Price Time & Materials Cost
3. Description of Service or Supplies: The contractor shall furnish and install ~1500 ft. of 12 Strand Pre-Terminated (Plenum) PRO-769-S-DP-6fiber optic cable, trench between Building 26 and Building 3 for direct burial fiber, run inside plant fiber in buildings 26 and 17 to telecom rooms, furnish and install Fiber optic patch panel couplers/connectors and provide OTDR testing report.
ESTIMATED COST: $17,000
4. Authority Cited: FAR 13.106-1(b)(1)
FAR 13.106-1(b)(1)(i): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization)
Reason for Authorized Cited: This action is deemed reasonably available from only one source because of Pegasus’s inimitable experience with MOTSU. The company performed the initial survey of the wiring/communication and port configuration of the USACE office spaces/area on MOTSU. Awarding to another contractor would result in duplicative costs, i.e.; resurveying, that will not be recovered through competition.
Additionally, Pegasus has a direct knowledge of the physical conditions, security requirements, and the environment inherent to working on MOTSU, that will, reasonably reduce the period of performance required to complete this requirement. Furthermore, Pegasus has the immediate availability of personnel certified to install the affected system components with personnel that already possess the necessary clearances to work on the communication systems as well as work on MOTSU.
Finally, this award to Pegasus, a Veteran Owned Small Business (VOSB) is needed to help meet USACE CESAW Small Business Goals established for FY24.
VOSB/SDVOSB numbers are at 1.87% with a required VOSB/SDVOSB goal of 2.34%, more awards to VOSB/SDVOSB concerns are required to reach the required goal for
FY24.
5. Efforts to Obtain Competition: Government intends to solicit and negotiate with only one source.
