Justification and Appmval for Other than Full and Open Competition for Purchase Requisition (PR) J6EOY0016A for Mobile App Solution and Hosting

FAR 6.302-2, Only.One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

Pursuant to the requirements of the Competition in Contracting Act (CICA), as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303- 1, the justification for the use of statutory authority under FAR Subprut 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

(1) Agency and Contracting Activity: The Depmtment of Homeland Security (DHS), Federal Law Enforcement Training Centers (FLETC), Procurement Division proposes to enter into a contract on a sole source basis for a Mobile App Solution and Hosting.

(2) Nature and/or Description of the action being proposed: This procurement is for a sole source contract with Modo Labs, to provide a Mobile Application Solution and Hosting for a base year and four (4) option years.

(3) Description of Supplies/Services: Modo Labs will provide a commercial-off-the-shelf (COTS) solution meeting FLETC requirements for a mobile application, configuration and s ng via a FEDRAMP certified cloud hosting infrastructure for an estimated www.fletc.gov

( 4) Identification of Statutory Authority Permitting Other than Full and Open Competition:

The statutory authority permitting other than full and open competition is 41 U.S.C.

253( c )(1) implemented by the Federal Acquisition Regulation (FAR) 6.302-1 entitled "Only One Responsible Source and No Other Supplies or Service Will Satisfy Agency Requirements."

(5) Determination by the Contracting Officer that the Anticipated Cost to the Govemment will represent the Best Value: The contracting officer will conduct cost and/or price af1alysis by comparison to independent government cost estimates generated for alternatives involving development of custom applications, as these are the only available standard for comparison.

(6) Description of the Market Research: Market research in support of this acquisition began in April, 2014, and continued through August, 2015. The market research effort included consultation with Gartner Analyst; internet searches ofleading mobile app solutions; consultation with in-house subject matter experts on mobile technology from both FLETC and DHS; and multiple Requests for I11f01matio11 (RFI) issued to all DHS Eagle II contract holders, and posted to FedBizOpps seeking any qualified sources, respectively.

Consultation with Gaiiner Analyst, a leading IT industry consultant, indicated that the FLETC would require HTML5 as well as native mobile technology.

Internet seai'Cl1es of leading mobile app solutions indicated that numerous companies could provide custom development capabilities and could meet the FLETC requirements with a custom solution.

Consultation with in-house subject matter expe11s at FLETC and DHS indicated that ce11ain commercial modules are only available using Native Application technology. The FLETC only has the technical resources to develop and support an HTML5 Web Based Application, not those using Native Application technology. Therefore, the FLETC does not have the capability to supp011 custom developed applications on an ongoing basis;

custom development will not meet the unique requirements of the FLETC.

RFI HSFLGL-15-I-00010 was issued to DHS Eagle II contract holders. Responses and the resulting application demonstrations indicated that all six of the respondents would be capable of developing a custom application to meet technical requirements. Unfortunately, as explained above, the FLETC cannot support custom development going forward without adding significant technical resources at increased cost. None of the respondents appear capable of offering a COTS product to meet,requirements.

Subsequent to the initial RFI above, RFI HSFLGL-15-1-00015 was posted to FedBizOpps seeking responses from any qualified firms. Only one respondent, Modo Labs, appears capable of offering a COTS product to meet requirements. Although each of the other ten respondents appears capable of meeting requirements with a custom developed application, none of them can offer a suitable COTS product.

As described above, the Mobile App IPT conducted extensive market research to analyze the marketplace in support of the Mobile App project and in accordance with FLETC designated Solution Engineering Lifecycle practices. Based on the results of this research, the IPT concluded that Modo Labs was the only company able to meet FLETC requirements without undertaldng custom development. A review of significant requirements and features follows.

a. Modo Labs offers the only app assembly system combination that would enable any type of user (such as non-technical PCO personnel), to rapidly build and simultaneously deploy the FLETC Mobile app to every major production channel: 1) native apps for Android and iPhone phone devices, 2) native apps for Android and iPhone tablet devices, 3) mobile web for phone devices, 4) mobile web for Android and iPhone tablet devices and 5) full web for desktops. This capability provides the FLETC the only way to address each of these important channels without hiring mobile experts to build custom versions for each platform and maintain them going forward. This will save the Government development time, developer cost and reduce our risk profile.

b. Modo Labs is the only software solution that includes pre-built module templates and screen types offering off-the-shelf features that are designed to be extensively customized by any type of user, to provide tutlque and modern User Interface and User Experience styles. Thls capability provides the FLETC the only way to have distinct and advanced mobile UI styles on all production channels without hiring mobile experts to build and suppmt custom versions for each platform.

c. Modo Labs provides branding features, including logos, word marks, colors, fonts and spacing to be implemented and uniquely applied throughout the FLETC app, at any time, without any custom development by or dependency on mobile experts. Thls capability is out of the box and directly available to FLETC administrators within the administration console.

d. Modo Labs offers the only system available to allow the FLETC to utilize Google-based campus maps, extended with customized layers, points of interest, classrooms, trnining venues such as Danis City, landmarks, and directions, and embed these customized map capabilities directly within any workflow of the mobile app. This capability will provide the FLETC a way to imbed a Google map representing any of the FLETC campuses directly within the mobile app at the time it is needed without exiting the app, so that location information is readily available to the end user. This capability will greatly enhance the user experience at FLETC and in the event of an emergency will aid users in having a quick reference to locations for exits.

e. Modo Labs offers the capability to add advanced modules and features to the FLETC mobile app at any time without the need to resubmit the app to the Google Play or Apple stores. This capability will give the FLETC the ability to quickly implement and incorporate seasonal or special purpose modules ( e.g., commencement, conferences, etc.) and will allow the application to scale to meet future needs.

f. Modo Labs provides the capability to deliver multi-role (e.g., staff, faculty, alumni, new students, parents, online students and on-campus students) and multi-site experiences (e.g., Glynco, Attesia, Charleston, Cheltenham) to users depending upon who they are and where they are physically based. This feature is supported out of the box and configured through the Administration Console by the administrator. This multi-user and multi-role capability provides the FLETC a way to personalize the experience for each type of mobile app user, without hiring mobile expe1ts to build custom extensions. This will greatly enhance the user experience because the application will automatically be tailored based on the geographic location of the user.

g. Modo Labs provides an "out of the box" messaging platfonn for delivering both native push notifications and in-app banner messaging for communications to students and other users. The platform will provide the FLETC with the ability to quickly deliver messages to specific users, groups of users and schedule the delivery of the message during a specific time frame. No technical sldlls are required to use this functionality, and it will eliminate the need for the FLETC to buy a separate specialized messaging solution. This ability will greatly impact security of the end user as they will be notified quickly of events at their location if immediate action is needed (active shooter, Black Flag, etc.).

h. Modo Labs provides the ability to seamlessly integrate with Blackboard using "Out of the Box" features. This is patticularly beneficial to the FLETC as it is cunently in the process of deploying its Blackboard based On- Line Campus Solution

(7) Any Other Factor Supp01ting the Use of Other Than Full and Open Competition: None.

(8) A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required:

Market research is a continuous process at the FLETC, and extensive research will be conducted prior to a follow-on requirement to determine if more COTS products are available at that time, or if increased technical resomces make alternate solutions feasible.

(9) I ce1tify that the data supp01ting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
