JUSTIFICATION & APPROVAL

OTHER THAN FULL AND OPEN COMPETITION

(SOLE SOURCE)

1. Requiring and Contracting Activity:

Requiring Activity: Commander Naval Construction Battalion Group TWO (NCBG TWO)

4902 Marvin Shields Blvd, Gulfport, MS 39501

Contracting Activity: Commanding Officer

NAVSUP Fleet Logistics Center Norfolk

1968 Gilbert Street

Norfolk, VA 23511-3392

Requisition Number: N4027320RC013AD

2. Description of the Action Being Approved:

This action is for the award of a sole source firm-fixed priced contract Meggitt Training Systems, Inc.

(MTSI), 296 Brogdon Road, Suwanee, GA 30024; utilizing the authority of Other Than Full and Open

Competition as permitted by 10 U.S.C. 2304(c)(1), and implemented by FAR 6.302-1, since there is only one responsible source and no other supplies or services will satisfy agency requirements.

3. Description of Supplies/Services:

The proposed acquisition is for the procurement of (10 each) P/N MG-50-SC-NG - M2 (.50 cal

Machine Gun): Non-Gun - Tethered, Weapon Simulator, WRTY - 12 Month Warranty, UID - UID

Labels for: 50ca, (10 each) MG-240G-50-NG - FN MAG M240G Machine Gun, Non-Gun - Tethered, Weapon Simulator, WRTY - 12 Month Warranty UID - UID Labels for: 240G, (16 each) SA-M9-BF-

50 - Beretta M9 Weapon Simulator - BlueFire®, WRTY - 12 Month Warranty, UID - UID Labels for:

M9s, (4 each) 1016341 - Weapon Trunkline, 3 Position (100, 125, & 150 psi), 5 ports, WRTY - 12

Month Warrantyas needed for all NCBG TWO FATS simulators located in Gulfport, MS. This is a one time procurement in the amount of $553,438.67.

Funding for the contract will use FY20 Operations and Maintenance Navy (O&M,N) appropriations.

4. Statutory Authority Permitting Sole Source:

The statutory authority permitting Other Than Full and Open Competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, as identified in paragraph 5, since there is only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority:

The authority FAR 6.302-1 cited in paragraph 4 above is applicable because the Government’s need can only be satisfied by Meggitt Training Systems, Inc. (MTSI) due to software developed and owned by Meggitt Training Systems, Inc. (MTSI),. This proprietary software is installed on NCBG TWO’s

Fire Arms Training Simulator (FATS) system. Similar simulator weapons are unable to operate with this software.

The authority FAR 6.302-1 cited in paragraph 4 above is applicable because services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to recovered through competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:

NAVSUP Fleet Logistics Center, Norfolk issued a Sources Sought on 17 August 2020, with a closing date of 20 August 2020, IAW DFARS PGI 206.302-1. Upon closing of the Sources Sought, the

Contracting Officer received no capabilities statements.

The Contracting Officer also reviewed beta.SAM and found that other agencies have obtained the same or similar equipment for other agencies as a Sole Source due to the software issue.

7. Determination of Fair and Reasonable Cost:

The Contracting Officer will determine that the prices negotiated for this acquisition are fair and reasonable before an award is made per FAR 15.404.

8. Actions to Remove Barriers to Future Competition:

For the reasons set forth in paragraph 5, NAVSUP FLC Norfolk has no plans, at this time, to compete future contracts for the type of services covered by this document.

9. Other Information: N/A

10. Contracting Point of Contact: The point of contact at the FLC Norfolk is Jill Joscelyn, Code
