Control No: NSB-J&A20-0059 Contractor: MD Helicopters, Inc Program/ Equipment: MD 530F as well as the final WLSS-C RFP were posted to FedBizOpps, the final being posted in August 2017 and satisfies the requirements of the Competition in Contracting Act and FAR 5, Publicizing Contract Actions. Therefore, TOs issued under fair opportunity do not require further synopsis in FedBizOpps.

b. Subcontracting Competition: The current contract contains all applicable FAR/DFARS clauses that require the prime contractor to obtain competition to the maximum extent practicable.

7. Actions to Increase Competition: As described in paragraph 5 above, a TO competition under the WLSS-C contract for future armed MD 530F service requirements has been conducted. As stated above, the effort is to serve as periods, if needed, pending the outcome of the third protest of the competitively awarded WLSS-C TO described above. MDHI is currently the only source possessing the total effort knowledge, expertise, and experience necessary to meet the current mission requirements for this bridge effort in the urgent timeframe required without a break in service. As stated above, the Government awarded a competitive WLSS-C TO which has since been protested. Based on established contract acquisition timelines, there is not sufficient time to award an additional competitive action preventing a break in service or degradation of aircraft mission availability. As a result, because this action is a short-term modification to an existing contract in order to avoid a break in service, additional actions to increase competition for this contract action are impracticable.

8. Market Research: IAW PGI 206.302-1, “When utilizing the authority at FAR 6.302-1, the contracting shall post a request for information or sources sought notice, and shall include the results of this inquiry in the justification required by FAR 6.303. This requirement to post may be waived by the Head of the Contracting Activity or designee.

The waiver authority may not be delegated lower than a general or flag officer or a member of the Senior Executive Service”. As previously stated a waiver for this requirement was approved by the SCO because of the exhaustive previous market research as listed below has already been conducted. The results of the market research show a competitive future for MASPO’s CLS requirements under the WLSS-C contract. A FAR Part 12 contract will not be utilized for this effort since the services and many of the parts are not considered commercial parts.

9. Interested Sources: As described in paragraph 7 above, interested sources for follow-on MD 530F services have been identified through the competitive WLSS-C contract award process. The notices required by FAR 5.201, shall be published on or about 27 February 2020, and any bids or proposals received in response to that notice shall be considered. No other sources have written to express an interest.
