JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity

2. Description of the Action Being Approved
This Justification and Approval (J&A) authorizes and approves on a sole source basis an increase to the estimated dollar value of the Fiscal Year (FY) 23 funding, adds funding for FY24, and permits the acquisition of up to 17 additional G/ATOR Systems under firm fixed price contract M67854-19-C-0043 which was awarded to Northrop Grumman Systems Corporation (NGSC), 1580A W. Nursery Road, Linthicum Heights, MD 21090-2202 in FY 2019.
3. Description of Supplies/Services
The current FRP contract is for the manufacturing, production, certification (through testing), and delivery of 30 G/ATOR FRP systems and operating spares in accordance with the Government Performance Specification. This J&A increases FY23 funding and adds FY24 funding to continue to acquire the same services described above. In addition, it provides for acquisition of 17 additional G/ATOR FRP systems in accordance with the Government Performance Specification.

Furthermore, re-engineering would result in a significant program delay, in excess of 10 years, based on developmental timeline for the G/ATOR program of record. Any delay in the production would prevent the scheduled deployment of all G/ATOR systems by 2026.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A sources sought notice, M67854-23-R-0035, was issued on 11 January 2023. The notice assesses industry’s capability to produce 17 G/ATOR systems capable of Identification Friend or Foe Mode 5/S, utilizing the Pallet Communications Support Processor (PCSP), with a fully populated array and delivery of operating spares and provide production, engineering, integration and testing, logistics, and program management support services. NGSC was the only company to respond. Based on the lack of respondents, NGSC is the only company interested in and capable of producing the additional 17 G/ATOR systems.
7. Determination of Fair and Reasonable Cost
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in paragraph 5, PEO LS has no plans to compete future contracts for the types supplies/services covered by this document. However, the program continues to implement and expand Should Cost GFE breakout initiatives to reduce the cost of the G/ATOR systems and other subcomponents. If another potential source emerges, PEO LS will assess whether competition for future requirements is feasible. Any future actions will be reviewed by PEO LS to offer competition to the greatest extent possible.
