JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION – FAR PART 6

1. CONTRACTING ACTIVITY: The responsible contracting activity is the U.S. Army Corps of

Engineers, Northwestern Division, Omaha District, Contracting Division (CENWO-CT), 1616 Capitol Avenue, Omaha, NE 68102.

2. DESCRIPTION OF ACTION: The approval is for a modification to an existing firm fixed price AE task order. Fund Site 97X4930 Defense Working Capital Fund.

3. DESCRIPTION OF SERVICES:

Government of Japan (GoJ) Project, MC9622 – Install Security Lighting Fuel Storage Depot includes modifications and replacement of most of the existing power distribution at the MCAS Futenma fueling site. These modifications to the existing power distribution directly conflict with the current MCAS Futenma PPS Phase 2 – 100% design project. This design revision will electrically deconflict and align the two projects.

The total estimated value of this modification is $15,600.00.

Electrical Design Updates Drawings ED401, E-401, EG401, E-506, ED601, E-601, and E701 are affected by MC9622 and will be updated

i. Identify applicable GoJ Project MC9622 design as existing

ii. Remove power distribution content from all drawings that GoJ Project

MC9622 covers

iii. Add two panelboards at the laboratory building to support new circuits

iv. Add panelboard at service entrance equipment location to support new circuits Specifications 26 08 00, 26 12 19.10, 26 20 00, and 16 36 23.00 20 are affected by MC9622 and will be updated to reflect the removal of power distribution no longer being provided Basis of Design: Update narrative to cover the new power distribution configuration

Structural Design Updates

Drawings S-005, S-109, S206, and S-514 are affected by MC9622 and will be updated

v. Remove transformer and electrical manhole

Basis of Design: Update narrative to remove all language referencing the new transformer and manhole

Civil Design Updates Drawings CD100, CS100, CS103, and CG100 are affected by MC9622 and will be updated

vi. Remove transformer and electrical manhole Basis of Design: Update narrative to remove all language referencing the new transformer and manhole

4. AUTHORITY CITED: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(iii)(B), gives DoD the authority to set aside requirements when there is only one responsible source and no other supplies or services will satisfy agency requirements.

5. REASON FOR AUTHORITY CITED:

Burns and McDonnell prepared full design documents for construction of fueling system improvements at eight Marine Corps Camps in Japan. The AE previously inspected the fuel facilities and prepared a Deficiency Summary Report (DSR) for each Camp which includes Futenma. The work under the task order includes the completion of a 60% Design Package, Final Design (100%) Package, and Ready-to Advertise (RTA) Contract Document Package per the Omaha District Design Guide (ODDG) and requirements set forth in the scope. The items that are included in this project are outlined on the final cut list for each site.

There are 3 separate design packages for the 8 camps on the task order:

1. Camp Futenma.

2. Camps Courtney, Gonsalves, Hansen, Kinser, Schwab, and Foster.

3. Camp Fuji.

Burns & McDonnell is the designer of record and has the historic familiarity of the Futenma requirement. They are a competent and experienced AE firm that has met the Governments requirement capabilities on multiple past efforts at this location. Utilizing them as the designer of record also has reduce the “turn-over” timeframe from design to construction management, ultimately reducing the overall total costs to the government. Burns & McDonnell is fully capable of completing this required task.

The design that is currently in place would not pass the Biddability, Constructability, Operability, Environmental, and Sustainability (BCOES) process. In particular, the Government of Japans (GOJ) design would not pass the biddability, constructability and operability portion of the BCOES. Aside from this, what the GOJ is attempting to include would be out of scope with the MATOC that this effort is currently executed under. The fueling system at MCAS Futenma would be inoperable and unable to support the Warfighter to meet current/future operational mission requirements. By performing this modification, the design revision will electrically align the systems accordingly.

To date, the task order award is in the amount of $1,539,779.23 and total invoiced $1,314,455.71. Remaining balance is $225,323.52. The contractor needs to finish the Draft RTA Submittal, Back Check Submittal and then the Final RTA Submittal. The timeframe for completion is 2022 March 25.

If the Government were to compete the work, there would be duplication of costs due to the effort of another AE firm. Another AE firm would likely need to start much of what has already been completed – over $1M effort put into the design product. An AE firm would need to validate the site and validate all the work that has been done to date and provide drawings with their design stamp. There are a limited number of contractors available to travel to Japan and the COVID-19 travel restrictions are making it more difficult and costly to execute design efforts. This would also delay the completion of the final product by 2022 March 25.

6. EFFORTS TO OBTAIN COMPETITION: A notice will not be posted in accordance with the exception FAR 5.202(a)(11). The proposed contract action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of 5.207 with respect to the current proposed contract action At the time of source selection, the potential contractors were pulled off the current Fuels AE MATOC.

W9128F-17-D-0019 was awarded to Burns and McDonnell on 29 Sept 2017. Considering the contract is now in its 4th year there has not been any effort to obtain further competition.

7. ACTIONS TO INCREASE COMPETITION: There currently is not any ongoing emphasis on increasing competition for this task order job requirement.

8. MARKET RESEARCH: Market research was conducted in accordance with FAR

10.002(b)(2)(i) on 24 July 2017. For this award, the Project Manager requested that a task order be executed against W9128F-17-D-0019 to Burns and McDonnell due to the historical familiarity of the requirement and being the most highly technical contractor for efforts in Japan. Market Research has not been conducted since.

9. INTERESTED SOURCES: A Sources Sought Notice was issued on 22 December 2021 with a response date of 7 January 2022. To date, no other sources have written to express an interest.
