1. Contracting Activity: Department of Veterans Affairs, VISN 07, Birmingham Medical Center, 700 19th St. S, Birmingham, AL35233. Network Contracting Office 7. 2237#: 521-23-4-4102-0214.
2. Nature and/or Description of the Action Being Approved: Birmingham VA Medical Center is in urgent need for acquisition subject matter experts related to contracting and procurement of goods and services to cover staffing shortages. The BVAMC is requesting a firm fixed priced contract with a vendor to establish proper staffing requirements.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: BVAMC is seeking a firm-fixed-price contract with a one-year base and the (3) one-year options for period of performance.
The estimated base cost is $1,019,200.00 with an overall value of $4,263,979.20. The base period of performance is to commence on the contract award for a period of not exceeding 1 year.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.
Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION) up to $5,000,000. Check the specific VAAR clause used below:

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Due to the urgent need in staffing requirements for these services, the Contracting Officer is authorizing the sole source award to an SDVOSB based on 38 U.S.C. 8127(c) and that the SDVOSB/VOSB concern has been determined to be a responsible source with respect to performance. The Vendor knows how to onboard their employees quickly and effectively to eliminate further downtime. The Contracting Officer also has established that if an RFQ was to be placed and the onboarding process time frame would hinder the service lines even further due to the nature of the work needed to be performed by the professional services. Eliminating a 30-day process would allow the Contractor to enter the requirement quickly, eliminate mishandling of current contracts’ proper contract procedures, and enhance the response requirements needed to maintain all service and supply buys needed to maintain this VAMC.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies: Due to the limited amount of time and the need for the support services. The Contracting Officer is utilizing the sole source award to an SDVOSB based on 38 U.S.C. 8127(c), and the SDVOSB/VOSB concern has been determined to be a responsible source with respect to performance. The next requirement, if needed to be continued beyond this performance period, will result in an RFQ posting to ensure there is proper competition among all SDVOSBs able to perform this requirement in the future. Due to the threshold amount of the procurement, an award document with this justification document will be posted once the award is issued.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
Based on market research of FPDS of contracts similar in nature. It has been determined that the pricing provided by the potential vendor is considered fair and reasonable.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: At this time, the Market Research conducted was minimal due to the time needed to establish this award quickly. The contracting officer reviewed FPDS’s historical data to determine the funding portion and proper level of services. Then verified VIP Certs

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. The Contracting Officer is authorizing the sole source award to an SDVOSB based on 38 U.S.C. 8127(c) and that the SDVOSB/VOSB concern has been determined to be a responsible source with respect to performance.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Veterans Management Services, Inc

A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: If these services are required after this performance period. The service line will supply a package timely to allow an RFQ to be posted for proper competition in the future. It would be in the best interest of BVAMC to be the sole source to VMSI throughout the duration of the contract in an effort to keep facility contracts on par.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
