About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a Land Mobile Radio (LMR) Communications Systems Services contract. The U.S. Army Contracting Command Rock Island (ACC-RI) is seeking a sole-source, firm-fixed-price contract with L3 Technologies, Inc. for LMR refresh maintenance services at the McAlester Army Ammunition Plant (MCAAP). The contract will cover maintenance of existing L3 Technologies radios, towers, and associated infrastructure, with the primary goal of bringing the current LMR system up to Army/JDIC standards and integrating it into the Army-Wide ACE program.

The justification emphasizes the critical nature of the radio communication system for MCAAP's operations, supporting emergency teams, first responders, fire, security, shipping, storage, production, and transportation personnel. Due to the urgency and specificity of the existing infrastructure, L3 Technologies is deemed the only viable vendor capable of providing immediate, cost-effective maintenance and system refresh. The contract includes an option provision, and while ACC-RI acknowledges the lack of competition, they plan to conduct additional market research for potential alternative vendors in future procurements. The contract is authorized under 10 U.S.C. 3204(a)(2) for unusual and compelling urgency.

Department of Army Justification and Approval for Other than

Full and Open Competition

1. Contracting Activity: U.S. Army Contracting Command Rock Island (ACC-RI) Rock Island Arsenal, Rock Island, IL 61299-8000.

2. Description of Action: The McAlester Army Ammunition Plant (MCAAP) office requests a year firm-fixed-purchase request, contract W519TC-25-P-2250, with L3 Technologies Incorporated for Land Mobile Radio (LMR) Communications Systems Services. ACC-RI projects award for and funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

3. Description of Supplies/Services: The LMR refresh maintenance for current installed L3 Technologies, INC. Radios, Towers, General Labor, recorder and overhead services. Each of the quantities are ordered in bulk service per each FY inclusive of supplies, services, software and licenses. The requested period of performance is

The proposed action will include an option provision. The Independent Government Estimate (IGE), signed on , estimated a dollar value of .

4. Authority Cited:

10 U.S.C. 3204(a)(2), as implemented by Federal Acquisition Regulation (FAR) 6.302-2, Unusual and compelling urgency.

5. Reason for Authority Cited:

For urgency under FAR 6.302-2: As described at FAR 6.302-2(a)(2), when the need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for the following MCAAP LMR refresh Maintenance Service requirement a.

. This can affect shipping/receiving of munition times. This contract could provide coverage to these areas, thus permitting multiple RR engines to operate at once. This would allow faster processing of shipments and enable MCAAP to meet/retain its mission requirements as a Tier 1 Depot.

b. The new contract in the will alleviate these issues of safety in those areas. It could help increase the amounts of radio coverage

The main users of these current and continued services are emergency teams, (first responders, Fire, and Security).

c.

Transportation also use the same radio system coverage.

d. In the event of an accident, fire, security issue, inclement weather warning, unexpected track hazard, or an illness/injury, good, reliable radio communication is essential.

6. Efforts to Obtain Competition: In accordance with FAR 5.202(a)(2), ACC-RI will not synopsize this action.

Because this is a sole source action, effective competition is not applicable. The Government will achieve subcontracting competition by making sure prime contractor obtains as much fair competition as possible in its subcontracting with making sure the contract and modifications contain proper FAR clause, 52.244-5, Competition in Subcontracting; which states that the contractor shall select subcontractors on a competitive basis to the maximum practicable extent.

7. Actions to Increase Competition: Additional Market research will be conducted before any follow-on actions are completed to see if there are any other vendors who can provide service for L3 Technologies, INC. LMRs.

8. Market Research: This is the first time acquisition for the service/repair/maintenance for LMR. The equipment was previously awarded under pool of contracts for LMR equipment and award was made to L3 Technologies, INC. under a delivery order Modification Base contract W52P1J-17-D-0037 in support of LMR Maintenance services at MCAAP. As a result, only L3 Technologies, INC. is the only vendor that can provide this effort. Additionally, due to urgency there is no known alternative services that provide cost and time efficient vendors who can provide this service immediately. A new system that could provide the required services and maintenance of MCAAPs tower areas was researched previously from either Motorola or L3 Technologies, INC. would be approximately cost approximately which is not economically feasible at this time.

As a result, only L3 Technologies, INC. service providers can provide the maintenance refresh service.

All radio users at MCAAP location utilize the L3 Technologies, INC. radio network per -17-D-0037. A loss of communication to these towers at

MCAAP would affecting first responders, Fire, Security, Shipping, Storage, Production, Shops, Railroad, Transportation, etc. These towers provide redundant coverage to of the base and allow continuity of operations.

The contract requirement for the existing system refresh is to bring all of the existing infrastructure up to current Army/JDIC standards, including hardware, software, security, third party issuances. It will also join the current standalone LMR system into the Army Wide ACE program, with associated benefits such as patches, security updates, tech and support. If the tower site addition is completed concurrently with the system refresh, it will be configured/installed as part of the system refresh at no additional costs.
