procurement is not feasible. The Government will continue its efforts to obtain a TDP from AM General that is sufficient to support competition for future acquisitions.

8. Market Research: PD LTV conducted market research in accordance with FAR

10.002(b)(2) and found no other source that is capable of providing new HMMWV Rolling Chassis without substantial, unrecoverable duplicative costs.

a. A sources sought notice was posted on the beta.SAM.gov website from 9 July –16

July 2020 to identify potential sources for HMMWV chassis production. The sources sought notice requested interested offerors to submit a response which supports the company's claim that it presently has the technology, qualifications, experience, and capabilities to produce new M1152A1B2 HMMWV non-drivable Rolling Chassis compliant with ATPD 2099E. No responses were received.

However, AM General is the OEM of the M1152A1B2 non-drivable chassis and owns the TDP for the most current configuration of the M1152A1B2 HMMWV to include the non-drivable Rolling Chassis as a sub-assembly to the vehicle. The current chassis configuration includes: upgraded and other hardware components necessary for integration onto the existing vehicle cab structure. AM General has produced more than 270,000 HMMWV and HMMWV chassis over the past 26 years that meet or exceed the ATPD.

b. In February 2020, PD LTV personnel reviewed on-line product literature from other military truck manufactures (e.g., Oshkosh Truck, BAE Systems and General Dynamics). This review disclosed that these sources are capable of producing vehicles when all technical data is available. In view of the fact that the Government does not have the necessary technical data to enable competitive re-procurement, this aspect of the Army’s market research effort did not reveal any additional viable sources for this requirement.

9. Interested Sources: To date, no other sources have written to express an interest in this requirement.

10. Other Facts:

a. Procurement History. AM General is the developer and sole manufacturer of the

HMMWV FOV and has produced over 270,000HMMWVs and HMMWV chassis for the U.S. Army and other customers since 1983.

1) Delivery Order W56HZV20F0356 was awarded 30 June 2020 under contract W56HZV-17-D-0071 to procure 200 each HMMWV Non-drivable Rolling Chassis in support of Foreign Military Sales (FMS) case EG-B-VIT for an Egyptian HMMWV rebuild program.

2) Contract W56HZV-17-D-0071 was awarded 29 August 2017 to AM General for HMMWV ECVs on a sole-source basis for FMS customers. The J&A was signed on 9 November 2016 pursuant to the authority of 10 U.S.C. 2304(c)(1), as implemented under FAR 6.302-1(a), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. A separate J&A was signed on 26 September 2016 for DoD customers. The DoD J&A was also approved under the authority of 10 U.S.C. 2304(c)(1), as implemented under FAR 6.302-1(a), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

3) A summary of the contents of paragraph 7 of the J&A signed on 9 November

2016 states, the Government did not have the TDP for the HMMWV’s nor were all the current Engineering

Change Proposals (ECPs) incorporated into the Government TDP. It was not in the best interest nor was it economical for the Government to develop a fully competitive procurement package for the additional quantities of HMMWVs.

The same still holds true with this current J&A.

4) No prior contracts for this requirement utilized full and open competition.

5) There are no unusual patterns identified by the procurement history.

6) There have been no significant changes in the circumstances justifying sole source procurement.
