2. Nature and/or description of the action being approved.
a. Acquisition purpose and objectives.
The purpose of this acquisition is to award a single delivery order against the General Services Administration’s (GSA) Multiple Award Schedule (MAS), to schedule holder, CSP Enterprise, under the Information Technology category. The objective of the delivery order is to procure IT hardware including laptops, desktops, tablets, and high-end computing. The delivery order will also include services such as a portal to track delivery, image and encryption support, warranty repairs, disposal, and Exchange Sales Authority.
The FDA/ Office of Information Management and Technology (OIMT)/Property, Receiving, and Distribution Branch (PRDB) serves as FDA’s one stop shop for all IT services. PRDB manages the procurement and deployment of IT Equipment. The Receiving Distribution Center (RDC) staff is responsible for receiving and delivering IT equipment (both from vendors and FDA customers), processing customer eOrder/Hardware tickets, monitoring and handling ServiceNow tickets accordingly, scheduling and coordinating pickup of surplus equipment from FDA facilities in HQ, shipping IT equipment to FDA locations in the field locations or customer remote locations due to maximum telework, maintaining a complete inventory of equipment (Accountable and Non- Accountable Property) within RDC stock, providing image/reimage support as needed, and topping off customer personal computers for new hire and PC refresh installations.

b. Project background.
The IT Hardware and related services were previously procured via a Blanket Purchase Agreement (BPA) "Personal Computer PC Refresh to include Exchange Sales Authority" HHSF223201510031B, awarded to CSP Enterprises, which expired on September 29, 2020.
The BPA included desktops, laptops, tablets, and Scientific Computers. All computers came with a 3-year (on-site) warranty to align with FDAs Refresh cycle. Warranty labels were applied to the underside of every laptop and the top of every desktop. Hardware under the BPA is considered Accountable Property by definition and is delivered with an FDA-supplied standard software image and a 3-part barcode: FDA barcode number is applied in the BIOS, FDA Barcode sticker is applied to the shell of the computer, and to the outside of each corresponding box. FDA spent a total $99,984,180.85 over the five (5) years ordering period of the BPA.
Prior to expiration of the BPA, FDA competed a follow-on requirement for the IT Hardware and related services as a single-award agency catalog against the National Aeronautics and Space Administration Solution for Enterprise-Wide Procurement (NASA SEWP V) Government-wide Acquisition Contract (GWAC). FDA’s source selection decision was protested, and the government has experienced delays in working through the logistics of corrective action to establish a new long-term ordering vehicle for the required IT Hardware and services.
Due to the delay in awarding a replacement contract, FDA’s IT hardware inventory has reached a critical low. This order seeks to replenish the FDA’s IT hardware inventory, inclusive of the required services, until the long-term acquisition solution can be established. In order to satisfy the need, the government can only accept the current brand name makes and models, outlined below, of IT equipment from the current reseller and service provider, CSP Enterprises.
The FDA is currently using the Dell computer models listed below:
o Dell 5510 – Standard Model o Dell Optiplex 7080 – Desktop Model o Dell 7310 – Lightweight Model o Dell Latitude 7210 2-in-1 – Tablet PC o Dell Latitude 7212 – Rugged Tablet o Dell Precision 7750 – Scientific Laptop o Dell 7920 (Low / Mid / High Ranges) – Scientific Workstation

The value for this delivery order is $19,780,904.00.
c. Contract Type.
The contract type is Firm Fixed Price (FFP).
4. The authority and supporting rationale (see FAR 8.405-6(a)(1)(i); (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
a. Acquisition authority.
This acquisition is conducted under the authority of the Multiple Award Schedule Program. In accordance with Federal Acquisition Regulation (FAR) 8.405-6(a), consideration of schedule contractors will be restricted to fewer than the number required at FAR 8.405-1, FAR 8.405-2, FAR 8.405-3 (i.e., fewer than three FSS contractors). FAR 8.405-6 (a)(1)(i), for a proposed order or BPA with an estimated value exceeding the micro-purchase threshold not placed or established in accordance with the procedures in FAR 8.405-1, FAR 8.405-2, or FAR 8.405-3, the only circumstances that may justify the actions are-
(A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays;
(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
This acquisition is conducted under the authority of the Multiple Award Schedule Program. In accordance with FAR 8.405-6(b), consideration of schedule contractors will be restricted only to the item peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
b. Demonstration of the proposed contractor(s) unique qualifications to provide the required supply or service.
• Name and address of the proposed contractor(s).

• Nature of the acquisition and proposed contractor(s) unique qualifications.
Pursuant to FAR 8.405-6(b), the government requires quantities of the following makes and models of IT Hardware currently in use in the FDA environment.
Historically, over the past 10 years, FDA has built an environment with Dell products for its end-user computing requirements. The FDA infrastructure is not set up to support multiple products at once (such as Dell, HP, and Lenovo). Introduction of another brand to FDA’s environment would result in significant re-engineering, testing, and implementation issues. For example, a new image for any other brand of computers would need to be developed by FDA OIMT engineers.
These activities would require an extensive amount of time to perform the conversion of their existing support activities including the conversion of current scripts, trainings, and applications.
Supporting multiple infrastructures consisting of different brand name hardware would introduce significant operational challenges such as the additional training required for helpdesk to support the FDA’s end users.
Additionally, pursuant to FAR 8.405-6(a)(1)(i)(C), CSP Enterprise was the GSA MAS Schedule holder under the aforementioned, competitively awarded BPA. CSP Enterprise is familiar with FDA’s platform and has access to FDA’s image, barcoding sequence, are FDA badged to support the warranty repairs assigned to them and have scanner support in place to scan each item as it is disposed of through the Exchange Sales Authority. In order for FDA to compete a one-time purchase, FDA would have to onboard staff, provide the vendor with FDAs approved image, allow for testing, provide the barcode sequence to ensure no duplicity occurs within FDAs current environment, review and approve the vendors FDA Barcode and Warranty Repair label. This would result in an additional delay, after award, of 2-3 months. FDA cannot allow for that additional time as we are anticipating running out of IT inventory between August – September 2021. This additional delay would result in FDA running out of computers for staff and New Hires, which would negatively impact the agency’s mission.
5. Determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).
GSA has already determined the prices of the supplies and services under FSS contracts, including rates for services offered at fixed hourly rates, to be fair and reasonable. Nonetheless, the Contracting Officer will request additional discounts and ensure the final order price if fair and reasonable prior to award.
6. Statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
FDA plans to award a multiple-award SEWP Agency Catalog for IT Hardware and related services by the end of fiscal year 21, which will be open and competitive.
