4. Authority:
☒FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold
(SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
The Department of Pathology has a need for Biomerieux VITEK 2 Consumable and Supplies for VITEK Analyzer. Numerous studies published in medical journals and articles demonstrate that VITEK 2 has superiority over other comparable products in sensitivity, specificity, and turnaround time for automated phenotypic identification of microbial pathogens. VITEK 2 meets GLWACH’s clinical needs. The analyzer is also ideal for the current space, staff, and IT infrastructure of the hospital.
The consumables and supplies for VITEK 2 are specific to the analyzer; there are no other products that could be used in lieu of them.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 ☒apply and will be followed.
Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A)
☒Action is a brand name restriction, over $25K. It will be redacted and posted with the solicitation.
7. Market Research:
Market research was conducted to identify all qualified sources. In accordance with FAR Part 8, market research was conducted for this acquisition to determine if the items could be acquired through the required sources of supplies and services. The Contract Specialist conducted a dynamic small business search with NAISC Code 325413 and key word “Reagents”. The results show that there are several socioeconomic groups that can provide the requested Reagents and Consumables. Further research of the possible SB vendors revealed that none of the small business vendors could provide the requested reagents and consumables.
A sources sought was posted on 12 March 2021 to beta.SAM.gov with a closing date of 19 March 2021. Zero interested vendors responded to the sources sought.
Previous market research history at W81K00-19-P-0244 VITEK Reagents and Consumables has revealed that was the sole respondent to solicitation
W81K00-19-Q-0163 that was posted to FedBizOps on 14 May 2019. This market research is current, accurate, and relevant to this requirement.
Based on the above findings, the Contracting Officer has determined that there is not enough justification to support a Small Business Set-Aside for this acquisition. Two (2) or more “authorized” small business vendors were not identified. Market research resulted in only one vendor due to the uniqueness and the nature of this requirement.
The Contracting Officer is recommending a sole source award to , a large business.
8. Other Facts: For future actions, the Government will reassess the market for available vendors, including but not limited to, issuing a Sources Sought Notice to determine market availability for brand name, or equal requirements. The Government will continue to seek new resources that will satisfy these requirements through continued market research, requests for Statements of Capability, and telephonic inquiries.
