About this file
This is a Limited-Sources Justification (LSJ) for a four-month, firm-fixed price short term BPA call for Salesforce Licensing and Professional Support through Carahsoft Technology Corp. The procurement, valued at $3,952,458.14, is for the Administration for Children and Families (ACF) within HHS to provide licensing for existing Salesforce OASIS applications, products, and modernization initiatives.
The justification indicates this is a follow-on requirement to contract #75P00122A00001/75ACF123F59002 which ends January 29, 2025. The new acquisition will utilize the same vendor under the mandatory HHS strategic sourcing Salesforce Suite Enterprise License Agreement BPA #47QTCA24A0002. The services support the Division of Unaccompanied Children Operations (DUCO) program, including applications like SponsorX, App Launcher, FFS Solutions, Monitor Solutions, and Knowledge Library. The justification cites brand name requirements and urgent timeline needs as reasons for limited competition. The document has been signed by key stakeholders including the Program Manager, Competition Advocate, and Small Business office representatives.

4. Authority:
ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.); Title 40 U.S.C. 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception and for each discuss how the cited authority applies in accordance with FAR 8.405-6(c)(2)(iv).
An urgent and compelling need exists, and following the procedures would result in unacceptable delays (FAR 8.405-6(a)(1)(i)(A));
Only one source is capable of providing the supplies or services required at the level or quality required because the supplies or services are unique or highly specialized (FAR 8.405-6(a)(1)(i)(B));
In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited sources procedures (FAR 8.405-6(a)(1)(i)(C)); or
An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer. (FAR 8.405-6(b)).
When competition is limited to items peculiar to one manufacturer, this justification must explain why the particular brand name, product, or feature is essential to the Government's requirements, and that market research indicates other companies' similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs in accordance with FAR 11.105.
The current situation presents a critical need for increased support in order to meet the end-user demand within the Division of Unaccompanied Children Operations (DUCO) under the Office of Refugee Resettlement (ORR), part of the Administration for Children and Families (ACF) within the Department of Health and Human Services (HHS). Due to current resource constraints, engineering support staff are being diverted to handle direct end-user requests. This approach is unsustainable and has hindered our ability to effectively and efficiently fulfill the care and placement requirements for Unaccompanied Children (UC).
This temporary four-month short term order is essential and represents the most feasible solution as we transition to a re-competed long term solution. The additional support must be implemented by January 30, 2025, to ensure the continued, safe placement and care of UC as mandated by the Homeland Security Act of 2002, §462, 6 U.S.C. § 279, which transferred these responsibilities from the former Immigration and Naturalization Service to ORR. The DUCO program is tasked with providing UC with a safe, appropriate, and minimally restrictive environment until a suitable sponsor is identified, and their immigration cases are resolved.
Due to the specific requirements of the DUCO program and its mandate, market research has confirmed that only this particular brand name, product, or service can meet the agency’s unique operational demands. No other alternatives can meet these specialized needs within the urgent timeframe, nor can they be reasonably modified to do so.
Therefore, to ensure compliance and operational continuity, the award of this BPA call on a brand-name basis is justified under FAR 8.405-6(b)(1).
5. Market Research:
Describe the extent of the market research conducted among the schedule holders and the results, or a statement of the reason that market research was not conducted. Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s need.
Currently we receive Salesforce professional support through Carahsoft. Due to the urgency, our recommendation is to continue this award with them as it requires detailed knowledge the of the existing systems and will need to work very closely with current teams to provide end user support and overall user experience. HHS has recently awarded the HHS Salesforce Suite Enterprise License Agreement BPA# 47QTCA24A0002.
Carahsoft Technology Corporation agrees to the following terms and conditions set forth herein for this single award BPA.
This will eliminate contracting and open market costs such as: the search for sources, the development of technical documents and solicitations, and the evaluation of quotes. This BPA will further decrease costs, reduce paperwork, and save time by eliminating the need for repetitive individual purchases from the MAS contract. The end result is to create a purchasing mechanism for the Government that works better and costs less.
6. Actions to Increase Competition:
Describe the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration prior to any subsequent acquisition for the supplies or services is made. If no such actions have been taken, explain why.
In order to increase competition for future requirements, the Government will conduct market research and post a sources sought notice to see what other companies can provide this requirement.
