JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ.

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves on a sole source basis a Firm

Fixed-Price contract with Kampi Components Co. Inc, Fairless Hills, PA, CAGE (7Z016), for the procurement of Support Equipment Change (SEC) Kits for the Liquid Coolant Filtration Unit

(LCFU) and associated LCFU-2AC-302-9 Data Plates. These Kits are required to incorporate

SEC-5820 into and upgrade the LCFU. The LCFU supports all APG Radar Systems (65, 73 and

79) that are used across all F/A-18 variants (A-G). LCFUs are used at all Aircraft Organizational

(O-Level) and Intermediate (I-Level) levels of maintenance supporting the APG Radar Systems.

3. Description of Supplies/Services.

This acquisition is for the procurement of fifty-five (55) SEC-5820 Kits for the LCFU and associated LCFU-2AC-302-9 Data Plates. These Kits are required to upgrade the LCFU that performs Organizational and Intermediate Maintenance tasks on the APG-65, 73 and 79 Radar

Systems on all F/A-18 A-G aircraft.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Kampi Components Co., Inc. is the sole, licensed business office of Mayhue Industries, CAGE

(51408). Mayhew is the Original Equipment Manufacturer (OEM), developer, manufacturer and the only source with the requisite knowledge, technical expertise and technical data for the

LCFU and LCFU SEC-5820 Kits. OEM Mayhew advised in an email dated 31 January 2020 that they no longer bid directly to the U.S. Government; and does all business through Kampi

Components Co., Inc. To be able to perform this requirement any other source would need to possess the drawings/technical data for the LCFU and SEC-5820 Kits.

The Government does not possess the drawing/technical data for the LCFU or the LCFU SEC-

5820 Kits to support a competitive acquisition. OEM Mayhew Industries through distributor

Kampi Components Co., Inc. is the “Design Activity” for the LCFU and LCFU SEC-Kits, not

NAVAIR. Mayhew Industries through distributor Kampi Components Co., Inc. is the only source that can meet the scheduled requirement.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In accordance with FAR Part 10, Market Research was conducted by a search of Part Number, NIIN, and Nomenclature via Federal Procurement Data System, Dynamic Small Business

Search, Google, Yahoo, and Dogpile internet search engines. Kampi Components Co., Inc.

(through OEM Mayhew Industries) was the only source found capable of meeting this requirement.

The Sources Sought notice required by DFARS 206.302-1(d) was published in betas am.gov on

24 February 2020. The Sources Sought notice closed on 02 March 2020 with no responses. The synopsis required by FAR 5.201 was published in betas am.gov on 02 March 2020. The synopsis closed on 17 March 2020 with no responses.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. An analysis of

Kampi Components Co., Inc. proposal will be performed by technical analysts and contract specialists, with the assistance of Defense Contract Management Agency (DCMA) and Defense

Contract Audit Agency (DCAA) auditors as needed. The Contracting Officer will analyze the various cost elements that are presented in the proposal, as well as review the actuals from previous procurements, if applicable. The Contracting Officer will (as needed) use Government expertise, including DCMA, DCAA, and other Government resources, to evaluate the proposal material, labor, and subcontracts. A detailed report, developed as part of the Government evaluation, will be utilized to establish a NAVAIR position. As discussed in this paragraph, the

Contracting Officer will use cost/or price analysis as the basis for negotiating a fair and reasonable price for the supplies and services covered by this J&A.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in paragraph 5, NAVAIR has no plan at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible.
