JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO

IDENTIFICATION OF THE AGENCY AND THE CONTRACTING OFFICE, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A “JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION.” PLEASE CITE THE

AUTHORITY AND TYPE OF JUSTIFICATION.

The United States Coast Guard Directorate of Logistics (DOL-94), Office of Procurement and Contracting, proposes to enter into a purchase order on a basis of other than full and open competition. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) implemented by the FAR subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.

Firm fixed price order. The Contractor shall provide the proper mix of personnel, management, supervision, materials, supplies, equipment, tools, transportation, and other items or services (except utilities and limited facilities) necessary to accomplish the Refuse Services at U.S. Coast Guard Base LA/LB, San Pedro, California.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER

SUPPLIES OR SERVICES CAN BE USED.

Contract HSCG84-17-C-A11391 was issued to Apex Waste System, Inc. on 09/08/2016 for a base year period of 10/01/2016 through 09/30/2017 with 4 one-year option periods 10/1/2017 through 09/30/2021. They are a Small Business agency. On 01 October 2021, the USCG will be transitioning into a new financial software which will cause an estimated delay in payments for up to 3 months, therefore the unit requested extension of services under current contract for up to six (6) months, through 31 March 2022, as Apex Waste System, Inc. has all the necessary containers in place. Awarding a sole source purchase order up to six (6) months will allow a seamless transition without a lapse in services.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).

Currently, the city of Los Angeles has established a Franchise for refuse services, but the company is unable to start services immediately, they have agreed to a six (6) month extension with current vendor Apex. This extension is enough time for the contracting office to award a new contract and give the contractor sufficient time to stand up and begin services.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

The proposed source is the only source in the area who has been performing Refuse services for the past five (5) years and has the experience, staffing and equipment to provide the service economically for the short bridge contract duration of 6 months. Any other vendor would not be able to amortize their costs over such a short period, nor would they even be able to procure the necessary equipment and supplies in the short time frame prior to performance start.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL

AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

An Adequate purchase description has been developed for the services required under this contract.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY

BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.

This six (6) month extension (01 October 2021 through 31 March 2022) will allow the contracting office ample time to award a new contract for Refuse Services at USCG Base LA/LB.
