About this file

This is a Justification and Approval (J&A) document for a sole-source federal contract acquisition under FAR 6.302-1 (Only One Responsible Source).

The Air Force Life Cycle Management Center (AFLCMC), Cryptologic and Cyber Systems Division (HNC), is acquiring repair services for Multifunctional Information Distribution System (MIDS) Low Volume Terminals (LVT) AN/USQ-140(v) and MIDS Joint Tactical Radio System (JTRS) AN/USQ-190(v). The requirement includes repair, overhaul, testing, alignment, calibration, and maintenance of Line Replaceable Units (LRUs) and Shop Replaceable Units (SRUs) supporting airborne, ground, and maritime platforms across all four U.S. military services and 42 allied nations. The contract will be a five-year Indefinite Delivery/Indefinite Quantity (IDIQ) Requirements Type Firm-Fixed Price (FFP) service repair contract awarded to L3 Harris Technologies, Inc. (CAGE 06401), located in Salt Lake City, Utah. The estimated contract cost is redacted but totals 1,330 Baseline Equipment Quantities (BEQs) over five years across both LVT and JTRS platforms, with Year 1 comprising 274 BEQs and Years 2-5 each comprising 264 BEQs. The period of performance is 60 months from award date.

The sole-source justification is based on L3 Harris's exclusive ownership of proprietary Technical Data Packages (TDPs), manufacturing repair knowledge, and NSA Type 1 certification required for cryptographic systems. The government lacks license rights to distribute technical data to alternative sources, and development of a competing capability would require approximately 84-96 months and substantial cost duplication. A Sources Sought/Request for Information was posted to SAM.gov on July 10, 2023, with a response date of July 27, 2023, yielding no viable alternative vendors. The document was approved on February 15, 2024, by the PEO/Head of Procuring Activity. Contract funding utilizes 3400 appropriations for U.S. military repairs, with Foreign Military Sales repairs funded by host nations.

August 2023 Page 2 of 8August 2023 Page 2 of 8

I. Agency and Contracting Activity.

This Justification and Approval is to request authority for Other Than Full and Open Competition supporting requirements generated for the Air Force Life Cycle Management Center, Command, Control, Communications, Intelligence and Networks Directorate (AFLCMC) Cryptologic and Cyber Systems Division (HNC). The contracting activity for this requirement is AFLCMC/HNCKA.

II. Nature and/or description of the action being approved.

Due to the circumstances described herein, the activity requests authority to acquire repair services for Multifunctional Information Distribution System (MIDS) Low Volume Terminals (LVT) AN/USQ-140(v) and MIDS Joint Tactical Radio System (JTRS) AN/USQ-190(v) using Other Than Full and Open Competition as prescribed by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will satisfy Agency Requirements. This action will result in the award of a five (5) year Indefinite Delivery/Indefinite Quantity (IDIQ) Requirements Type Firm-Fixed Price (FFP), service repair contract. AFLCMC/HNC memorandum dated 28 Oct 2015 established Lackland AFB, TX as the Cryptologic and Cyber Systems Division (CCSD) and Central Authority in managing Communications Security (COMSEC) Controlled Cryptographic Items (CCI). In addition, AFMAN 17-1302 designated AFLCMC/HNC responsible for COMSEC material life cycle management to include acquisition, program management, item management, technical service, stock, storage, distribution, and final disposition. Management of MIDS LVT and MIDS JTRS will transfer to AFLCMC/HNC on 1 October 2024 in order to comply with these directives. The Air Force supply systems will reflect AFLCMC/HNC as the Source of Supply (SOS) and HNC will utilize existing contracts awarded from the 407th Supply Chain Management Squadron (SCMS) for depot repair of Air Force, Army, Marine and Foreign Military Sales (FMS) assets until the award of our local contract.

This sole source requirement will be acquired from the following company:

L3 Harris Technologies, INC 640 North 2200 West Salt Lake City, Utah 84116-2925 Cage: 06401 Large Business

III. Description of supplies/services required to meet agency needs.

This requirement is for repair services on MIDS LVT and MIDS JTRS, Line Replaceable Units (LRUs) and Shop Replaceable Units (SRUs). The LRUs and SRUs support airborne, ground, and maritime platforms. The services include all actions required to return the end item to a serviceable condition in the latest hardware/ software configuration to ensure terminal-to-terminal interoperability between MIDS and Link 16 terminal platform variants. This includes all necessary labor, materials, facilities, and equipment to analyze, troubleshoot, repair, overhaul, and test MIDS items, assemblies and parts. In addition, services for alignment, adjustment, calibration, testing, movement, storage and reporting status. This repair effort supports all United States Military and Foreign Military Sales for MIDS platforms supported under AFLCMC/HNC. MIDS is a joint service and international program that requires depot support for multiple configurations, as well as the ability to support varying configurations from multiple sources. MIDS is comprised of 12 different configurations supporting 31 separate platforms and is utilized by all four United States military services (Army, Air Force, Navy, and Marines) in addition to 42 different nations. The US repair efforts will be funded utilizing 3400 funding via individual task orders, FMS repairs will be funded by the host nation. The estimated period of performance

VIII. Any other facts supporting the use of Other Than Full and Open Competition.

None.

IX. List of any sources that expressed, in writing, an interest in the acquisition.

None.

X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.

MIDS LVT/JTRS is a jointly managed program between the Navy's MIDS International Program Office (MIDS-IPO) and the Air Force (AF). Although AF has Primary Inventory Control Authority for MIDS sustainment, it is a limited authority as the Navy manages the configuration control of the MIDS terminals. The Government does not have the technical data needed to compete using full and open competition procedures.

The plan to break barriers is to continue engaging with the OEM on selling the MIDS technical data to the Government, without the technical data no other solution can be identified. Any source other than L3H would have to reverse engineer the items, create a drawing package and incur associated cost for qualification and testing which would be cost prohibitive due to the redesign. Accomplish yearly market investigations and monitoring of technical writings to discover any prospective repair vendors. Another repair services contract will be required after this contract award expires, the MIDS team will periodically monitor NSA endorsements of like products. There have not been any additional vendors endorsed for this equipment. The OEM was queried on 17 October 2023 and they confirmed that they have no intentions on sharing or selling their data rights. The MIDS team will periodically query the OEM to verify if they have released repair capabilities to other entities.

The prior J&A follow on from the 407th SCMS and their plan to overcome any barriers for future acquisitions was to request a quote for the purchase of the OEM's technical data. They accomplished this request on 20 May 2018, and the OEM refused to sell any technical data.
