About this file
This document is a Justification and Approval for an Exception to Fair Opportunity under Federal Acquisition Regulation Subpart 16.5, issued by the Defense Information Systems Agency (DISA) on behalf of the Missile Defense Agency (MDA). The exception approval (Number JA26-043) authorizes the issuance of a firm-fixed price task order directly to Amazon Web Services (AWS), Inc. against the Joint Warfighting Cloud Capability (JWCC) Indefinite Delivery/Indefinite Quantity contract (HC105023D0005). The procurement is titled "Cloud Environment - Off-Premise Segment 2" with an estimated total value and a performance period consisting of a 12-month base period, one 12-month option period, and one 8-month option period, funded by Research, Development, Test, & Evaluation (RDT&E) resources.
The requirement encompasses cloud services and support for MDA's hybrid cloud environment at classification levels including Unclassified Impact Level 5, Secret IL6, and Secret/Special Access Required/Top Secret levels. Required services include connectivity to the cloud service provider, compute, memory, storage, networking, security, databases, applications, DevSecOps, containerization, orchestration, Cross Domain Solutions, Artificial Intelligence/Machine Learning, and cloud support for MDA's Research, Development, Test & Evaluation and Next-Generation Missile Defense efforts. The justification for sole-source procurement emphasizes AWS's unique qualifications, including its existing accredited environment, 5,000+ existing cloud instances, specialized security architectures, and seamless integration capabilities that cannot be replicated by other cloud service providers without unacceptable delays and cost duplication. MDA conducted market research from December 2025 through March 2026, with an Additional Research to Support an Exception to Fair Opportunity issued February 23, 2026, confirming AWS as the only capable provider meeting the Government's classified environment and integration requirements.
