About this file
This Justification and Approval (J&A) document supports a sole-source procurement for emergency maintenance on the USS IWO JIMA (LHD-7). The Navy is awarding a delivery order to Tecnico Corporation under contract N00024-22-D-4438 for urgent repairs to the ship's rudder stock upper bearing. The critical maintenance is necessitated by water intrusion discovered during inspections following a rudder failure on another vessel, which poses a high risk of catastrophic rudder failure.
The work includes installing a port rudder stock upper bearing, bilge cleaning, and pumping, to be accomplished using FY25 Operation and Maintenance, Navy (OM&N) funds. The procurement is being executed under FAR 16.505(b)(2)(i)(A) due to the urgent agency need, with Tecnico Corporation identified as the leading expert capable of meeting the immediate requirements. The repairs are essential to enable the USS IWO JIMA to meet its fleet mission commitments and operational readiness, with the work deemed time-sensitive to prevent potential mission interruption.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY
The USS IWO JIMA (LHD 7) was under way preparing for national tasking. Following the USS BOXER (LHD 4) rudder failure, USS IWO JIMA (LHD 7) conducted inspections and found water intrusion. Due to the presence of water this leaves the USS IWO JIMA (LHD 7) at high risk of catastrophic failure of the rudders. USS IWO JIMA requires immediate emergent repairs to the upper rudder bearings. The current condition of the rudder bearings does not allow for the USS IWO JIIMA to deploy until repairs are completed. The RMC cannot complete these repairs without the assistance of a PRIME contractor. The rudder bearings is essential to accomplishing all of the ship's operations underway. Any prolonged postponement in the award of this repair to TECNICO CORPORATION would result in serious injury to the U.S. Government because the necessary repairs to the USS IWO JIMA (LHD 7) rudder bearings would not be operation in time for the vessel to meet its immediate and urgent tasking, scheduled operational commitments, and the ship will not be able to perform its national mission in time of war until the upper rudder bearing install is complete. Additionally, the immediate award of this package is necessary due to the ship's critical tasking. TECNICO CORPORATION is the leading expert for this type of complex repair and technically acceptable Lead Maintenance Activity. Further, TECNICO CORPORATION has required equipment and is the only company able to meet the Government's immediate requirement to provide repair to the USS IWO JIMA (LHD 7) Upper Rudder Bearings, in order for the USS IWO JIMA (LHD 7) to meet is fleet mission commitments. To Award this EMERGENT to TECNICO CORPORATION under exception for opportunity provides the Government the appropriate avenue to accomplish this repair within the allotted Period of Performance. These repairs are essential for the delivery of mission capable ship. Without the repairs scheduled for the EMERGENT the main engines would not be operation in time for the vessel to meet its immediate and urgent tasking, scheduled operational commitments, and the ship will not be able to perform its national mission in time of war until the Upper Bearings are complete.
6. DETERMINATION OF FAIR AND REASONABLE COSTS
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The estimated cost of this work item is based upon historical data as well as the Independent Government Estimate (IGE) and the Project Manager's (PM) technical knowledge associated with the estimated man hours and material

costs to complete this work. Additionally, the contractor's fully burdened ship repair labor rate and material burden rate were determined to be fair and reasonable at t ime of contract and delivery order award. The supported information provided should be sufficient to support the fair and reasonable cost determination of the procurement.
L_ACTIONS TO REMOVE BARRIERS TO COMPETITION
For reasons set forth in paragraph 5 and 6, market research was not conducted. The critical nature of the work requires that it is started immediately. Future acquisitions for similar work will be reviewed by the Contracting Officer on a case by case basis to promote the use offull and open competition in the acquisition process where possible under this multiple delivery-order contract, where possible and practicable in accordance with FAR Subpart 16.5. In addition, a copy of the change(s) covered by this justification wi ll be forwarded to Code 200, Planning and Engineering, and Code 300 Waterfront Operations for consideration of similar work requirements in future solicitations.
