About this file
This document is a Memorandum justifying the use of other than full and open competition for an acquisition under the simplified acquisition threshold. The procurement is for a 2.5-year boiler inspection and hydro service for the USNS MERCY, specifically targeting port and starboard boiler inspections for ABS and USCG. Clark Reliance is identified as the sole source vendor, with justification based on proprietary rights, standardization, and form/fit/function requirements. The document highlights that Clark Reliance owns the technical drawings, is the designer, and is the only source capable of ensuring correct material procurement with the specific expertise to identify and provide compatible boiler inspection and hydro parts for the existing equipment configuration. The required delivery date is 02/25/2026, and the procurement is intended to satisfy the Military Sealift Command's (MSC) standardization initiative for T-AH 19 vessel parts.

1. In considering the references, FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contacting Officers may solicit from one source if the Contracting Officer determines that, under the circumstances of the contract action, only one source is reasonably available (e.g., urgency, exclusive licensing, brand-name, or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition because only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
