About this file

This document is a Justification and Approval (J&A) for a sole source modification to an existing contract with ESO Solutions, Inc. The U.S. Army Medical Research Acquisition Activity (USAMRAA) is consolidating two separate contracts for technological and maintenance support to the Department of Defense Trauma Registry (DoDTR) and its "Store and Forward" (S&F) data collector software under contract number HT942523C0064. The modification will add maintenance support for the S&F software, which is critical for collecting trauma data in contingency operations with limited bandwidth.

The modification will cover Option Periods 2-4 from September 2025 through September 2028, using Operations and Maintenance (O&M) funding. ESO Solutions is the sole source because they own the intellectual property rights to the software, which contains multiple databases, web interfaces, and workflow processes essential to the Joint Trauma System's mission. The software is used to track DoD trauma injuries across various operational theaters, helping combatant commanders make real-time decisions, provide material developers with critical data, and assist the medical community in training and improving combat casualty care.

Justification and Approval (J&A) Modified for Federal Acquisition Regulation (FAR) 13.501

1. Identification of the Agency and Contracting Activity:

The contracting activity for this action is the U.S. Army Medical Research Acquisition Activity (USAMRAA), Contracts Group 2.

2. Nature and/or Description of Action being Approved:

The requiring activity for this action, the Joint Trauma System (JTS) requires a sole source modification to contract number HT942523C0064 to add maintenance support for Store and Forward data software application to be completed by the contractor, ESO Solutions, Inc. ESO Solutions Inc provides similar maintenance to the Department of Defense Trauma Registry (DoDTR) under contract number HT942523C0064. HT942523C0064 was awarded using Sole Source J&A Number JA-23-05-1319. This will be an individual, firm-fixed price modification using DHP Funds.

3. Description of Supplies/Services:

Currently the Government holds two separate contracts with ESO Solutions for

1) Technological and maintenance support to the Department of Defense Trauma Registry (DoDTR), under contract number HT942523C0064, and

2) Technological and maintenance support to the Department of Defense Trauma Registry (DoDTR) “Store and Forward” (S&F) data collector software, under contract number W81XWH20P0178.

These contracts maintain two separate functions of the DoDTR. This modification will consolidate them into one contract under HT942523C0064. The current Period of Performance of W81XWH20P0178 ends 28 September 2025 and the next Option of HT942523C0064 to be exercised will start 22 September 2025.

The services to be added to contract HT942523C0064 provide technological and maintenance support to the DoDTR S&F software that is utilized in contingency operations that do not have adequate bandwidth for the full utilization of the DoDTR. The S&F version is a continual match to changes and upgrades to the DoDTR and insures both logic and data fields of the trauma data set remain consistent.

2 NOV 2024

This product provides a critical benchmark for the Military Health System of care rendered at the point of injury in the most remote and austere of locations. The data is aggregated to provide information to all sections of the JTS, with priority to the Tactical Combat Casualty Care (TCCC) committees and the four-tiered TCCC training programs for active, guard and reserve component medical personnel.

The support of this contract complies to the requirements set forth in DoD Instruction (DoDI)

6040.47 and the National Defense Authorization Act (NDAA) Fiscal Year 2017 Sections 707 and 708.

4. Statutory Authority Permitting the Sole Source Acquisition:

41 United States Code 1901 as implemented in Federal Acquisition Regulation 13.501(a)(1)(i), sole source (including Brand Name Only requirements) under the authority of the simplified procedures for certain commercial items.

5. Rationale Justifying Use of Authority Cited:

The JTS is dedicated to performance improvement in the care of combat wounded via data collection, performance improvement and development of data driven clinical practice guidelines. The use of the data by doctors, nurses, analysts, and researchers is changing trauma medicine and combat casualty care and improving outcomes for the severely wounded warrior.

Thus, collection and analysis of patient health data is mission critical. The vehicle for collecting this data is the DoDTR. JTS uses the DoDTR to develop best practices for multiple levels of care for battle and non-battle trauma patients and providers in austere environments. It is imperative to have routine and emergency maintenance available as JTS partners work around the clock and around the globe. A multi-disciplinary approach reduces combat morbidity and mortality by identifying trends or gaps in care and bridging the gaps. ESO Solutions Inc. developed specialized software (DoDTR) to track all Department of Defense (DoD) trauma injuries for the Joint Theater Trauma System Center of Excellence – Trauma (JTS – CoE). This custom-made proprietary software is used in current theaters of operation to include Iraq; Afghanistan; Africa and INDOPACOM. The maintenance, updates, and technical support will allow the DoDTR and S&F software to continue the collection of trauma data which allows combatant Commanders to make real time decisions based on wounding pattern(s), provides material developers critical data on current needs, and assists the Medical Community to train for currency and competency on current injuries which allows the war fighter the best chance of survival. The DoDTR is

proprietary and only ESO Solutions can provide update(s), maintenance, and technical support as they are the Sole Developer of this software.

ESO Solutions owns Intellectual Property Rights to the source code of this critical software which contains multiple databases, web interfaces, and workflows processes to aid in JTS’s mission. This web interface and workflow process technique is also copyrighted. No other product on the market offers the depth and breadth of data collection required for JTS and no other vendor has the rights to maintain or update the DoDTR or S&F software.

Combining these two contracts will provide easier oversight and administration of the required services by having them under one contract versus two separate contracts with the same vendor.

6. Efforts to Obtain Competition:

The Contracting Officer shall publish the notices required by FAR 5.201.

To date, no other sources have expressed written interest in the required tasks.

A notice of intent to sole source this modification will be posted to SAM.gov.

7. Actions to Increase Competition/Remove or Overcome any Barriers to Competition:

JTS will continue to survey the market of trauma data collection to identify state-of-the-art technology or software that may become available. At present, DoDTR and S&F product is the only solution to meet JTS’s requirements and due to ESO Solution’s exclusive ability to maintain the software, no actions can be implemented to increase competition. Future competition may be appropriate if the JTS’s requirements evolve and require re-competition of the software solution.

Working in collaboration with the Contracting Officer, the JTS will seek competition to the greatest extent practicable.

8. Market Research:

Market research, to include vendor searches in SAM and Online searches, completed in May 2025 indicates that the only available source is ESO Solutions.

9. Other Facts:

a. Procurement History:

(1) Is this a new requirement? No

(2) If 9.a.(1) is No, was the action just prior to this one competed? No, The current contract, HT942523C0064, was awarded to ESO Solutions using Sole Source J&A Number JA-23-05-1319

b. Additional Information: Because this is a modification to an active contract, the only source able to complete the required tasks is ESO Solutions.

10. Interested Sources: ESO Solutions
