About this file

This document is a Justification and Approval (J&A) for a three-year, Firm Fixed Price (FFP) requirements contract to acquire Mine Roller Adapter Kits (MRAK) for the U.S. Army Stryker Brigade Combat Team. The MRAKs will enable Stryker Infantry Carrier Vehicles to operate mine rollers, which detonate mines along cleared routes. The contract is estimated at $4,814,820 for 46 MRAKs, to be awarded to the original equipment manufacturer, General Dynamics Land Systems, due to their exclusive technical data package. The Government determined that the cost to reverse engineer the MRAK would exceed any potential savings from competition. No other sources responded to market research efforts. This will likely be the last buy as the Stryker Flat Bottom vehicles are being phased out. The procurement history indicates previous sole-source awards for this requirement.

CMO Control No: 2024‐050

Department of Army Justification and Approval for Other Than Full and

Open Competition Justification

1. Contracting Activity: U.S. Army Contracting Command-Detroit Arsenal (ACC-DTA)

2. Description of Action: This action will result in a new three-year, Firm Fixed Price (FFP) requirements contract to General Dynamics Land Systems (GDLS) for Mine Roller Adapter Kits (MRAK), Part Number (PN) 10681656-011, using Other Procurement Army (Weapons and Tracked Combat Vehicles (WTCV)) funds.

3. Description of Supplies/Services: Under the proposed new contract, the Program Manager Stryker Brigade Combat Team (PM SBCT) will acquire the MRAK. The MRAK is a Stryker deployment kit that enables the Stryker Infantry Carrier Vehicle to operate a mine roller. Without an MRAK, only a Stryker Engineering Support Vehicle is equipped to operate a mine roller. The mine roller provides mine proofing of a cleared route, detonating mines by exerting a downward force on each roller.

The contract estimated value of 46 each (ea) MRAKs is $4,814,820.

4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1(a)(2) - “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. This authority applies when supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

5. Reason for Authority Cited:

a. Background: The MRAK is designed by GDLS, the Original Equipment Manufacturer (OEM). Only GDLS possesses the complete and detailed Technical Data Package (TDP) required to produce the MRAK. The Government does not possess rights to GDLS’ complete and detailed TDP required for competitive procurement. On 01 December 2023, the Government inquired to GDLS about purchasing Limited Rights to the TDP or the full TDP. In response, on 18 March 2024, GDLS declined to sell either rights or the TDP.

b. Duplication of Cost: As mentioned above, the Government does not own the TDP for the MRAK. To competitively procure the MRAK, the Government would need to reverse engineer the MRAK to develop a TDP. Table 1 below shows the activities and estimated costs to reverse engineer the MRAK. The estimated total cost for all these efforts is $4.9 million (M).

MRAK is correct and meets performance requirements; integration testing to ensure the MRAK integrates with the ICV and mine roller; and live exercise testing to ensure the whole system works together while the vehicle is operational. This section also includes test support costs for maintenance and engineering support required to ensure vehicles and equipment remain operable during testing. These estimated testing costs are based on similar test efforts in PM SBCT.

Per this new MRAK requirements contract, an estimated 46ea MRAKs are being purchased at an estimated unit cost of $104,670 and a total estimated cost of $4,814,820. Assuming a 15% savings is achieved through competition, the unit cost could potentially be $88,969.50, or a savings of $15,700.50 per unit could potentially be achieved. In order to achieve savings, the Government would need to competitively procure an additional 312 MRAKs to offset the development cost of $4,903,510.38. Over the last four years, the average yearly demand for MRAK sent to the field is one each per year. At this rate, it would take 312 years to offset the development cost of competitive procurement. In addition, this is anticipated to be the last time buy because this MRAK is for Flat Bottom Only vehicles, which are in the process of being divested and replaced by Double V- Hull vehicles. Based on this information, it is not in the Government’s best interest to competitively procure the MRAKs. A total of 46 ea MRAKs have been provided on Presidential Drawdown (PD) to support This requirement is to replenish the Government’s MRAKs that were provided to support At this time, funding is currently available for 20 ea MRAKs. The remaining quantities will be procured as additional funding becomes available.

6. Efforts to Obtain Competition:

a. Effective Competition: The Government intends to solicit only GDLS, for the MRAKs, based on the rationale provided in Section 5. The Government will post any notices required by FAR 5.201, and any responses from responsible sources will be considered.

b. Subcontracting Competition: To ensure the contractor competitively awards subcontracts to the maximum extent possible, the resultant contract will contain all applicable FAR and Defense Federal Acquisition Regulation Supplement (DFARs) subcontracting clauses. GDLS, as a large business, will also be required to submit a subcontracting plan for review and approval in accordance with FAR 52.219-9 "Small Business Subcontracting Plan."

7. Actions to Increase Competition: Currently, the Government is not taking further action to increase competition, since we are not planning to buy anymore MRAKs after this procurement.

8. Market Research: On 06 September 2023, PMO-SBCT and ACC-DTA posted a Sources Sought Market Research notice to SAM.GOV that was open for 13 days to solicit interest for the MRAK. All responsible sources were encouraged to submit a capability statement, proposal, or quotation for the United States Government (USG) to consider. The Government received no responses, including the original OEM GDLS.

ACC-DTA also conducted internet searches in January 2024 utilizing Google for other sources that could potentially perform this effort using the terms, “Mine Roller Adapter Kit,” and “10681656-011 (GDLS P/N for original MRAK)”, and “Flat Bottom Mine Roller Adapter Kit”. No contracts for other sources were found using the search criteria. The same search terms were used to search contractdirectory.gov, Web Federal Logistics Information System, Logistics Data Analysis Center, and other databases; searches on the databases did not result in locating additional sources for the requirement.

9. Interested Sources: To date, no other sources have written to express an interest in producing the MRAK.
