Department of the Army Sole Source Justification for Purchases using

Simplified Procedures for Certain Commercial Items

1. Contracting Activity: The United States Army Contracting Command- Detroit Arsenal (ACC-DTA), MI is the contracting activity for this action.

2. Description of Action: ACC-DTA proposes to solicit and award, a Firm Fixed Price (FFP) contract on a sole source basis, consisting of a one-year period, to Patterson Pope, Inc. (herein after referred to as “the Contractor” or the “Service Provider”) 1859 C Beaver Ridge Circle, Norcross, GA 30071, CAGE Code:

1H7V5, Unique Entity ID: QB7GNEMZNLA7, the sole-authorized Georgia dealer of Spacesaver Products, to provide a Spacesaver High-Density Small Arms Rack System to the U.S. Army Armor & Cavalry Training Support Facility (ACTSF).

The resulting contract will consist of a one-year period, with a projected performance period to begin in August 2024. Fiscal Year (FY) 2024 Operations and Maintenance (OMA) funds will be utilized.

3. Description of Supplies/Services: This proposed procurement effort will be to design, fabricate, deliver, and install a single entry high density storage systems on a L-rail system with sixty-three (63) weapons racks, four (4) sections of wide span static shelving, and one (1) section of heavy duty four-post static shelving with a 14 gauge steel diamond plated steel sub floor over the entire system at the ACTSF.

Services shall include dust mitigation, training, warranty support, and stabilization of the completed Spacesaver Systems.

a. The total estimated dollar value of the proposed action is:

b. The primary place of performance is the U.S Army Armor & Cavalry Training Support Facility, located at Building 5500, 6078 Bradley Drive, Fort Moore, Georgia, 31905. Building 5500 is a 96,000 facility and is located on the Harmony Church section of Fort Moore. The facility is owned by the U.S.

Army and operated by the U.S. Army Center of Military History.

4. Authority Cited: The statutory authority permitting other than full and open competition using simplified procedures for certain commercial products in sole source (including brand name) acquisitions is 10 United States Code (U.S.C.) Section 3205 and 41 U.S.C. Section 1901, as implemented by FAR 13.500(a) and 13.501(a). Specifically, FAR 13.500(a), "authorizes the use of simplified procedures for the acquisition of supplies and services in amounts greater than the simplified acquisition threshold but not exceeding $7.5 million, including options, if the contracting officer reasonably expects, based on the nature of the supplies or services sought, and on market research, that offers will include only commercial products or commercial services." Moreover, FAR 13.501(a) provides documentation and publication requirements for, "sole source acquisitions (including brand name).”

5. Reason for Authority Cited: Under the terms of an undated exclusivity letter provided to ACC-DTA from Spacesaver Corporation Chief Executive Officer (CEO), Mr. Mark Haubenschild, Patterson Pope Inc.

is named as the sole authorized Spacesaver Area Contractor in the state of Georgia. This letter names Patterson Pope Inc. as the sole authority to sell, service and install Spacesaver High Density Mobile Storage Systems in this area. The letters also states that no other party other than Patterson Pope Inc. is authorized, trained, or certified to conduct Spacesaver work and that no other companies can purchase replacement or upgrade parts for the Spacesaver systems in the state of Georgia. Additionally, the letter also states the any existing Spacesaver system must be moved by a factory trained and certified Spacesaver installer to maintain its warranty and the availability of parts. a. Background: The ACTSF has been the Army's main repository of over 248 years of history about the American Armor and Cavalry Soldiers and the heritage of the United States Armor Branch since 1948. The Armor and Cavalry Collection, the largest of its kind in the nation, contains original vehicles, artillery pieces, rotary aircraft, firearms, edged weapons, uniforms, and accouterments, many of which are priceless, one-of-a- kind items, used by American Tankers and Cavalry Scouts throughout the nation's history. In 2011, the Armor & Cavalry Collection was moved from its original location at Fort Knox, Kentucky to what is now Fort Moore, Georgia. During that time there was no funding for the Armor & Cavalry Collection to receive its own facilities. Since that time, the ACTSF’s collection of nearly 600 small arms and weapons has been collocated and stored in the arms room vault of the National Infantry Museum and Soldier Center (NIM-SC), The NIM-SC is a sister organization of the ACTSF and part of the U.S. Army Center of Military History. Since 2011, the ACTSF’s weapons have been stored in the NIM-SC’s Spacesaver high density weapons storage system.

During this time, this Spacesaver system has stored a large variety of unique weapons ranging from small handguns to large anti-tank weapons and launchers.

b. Justification: In 2022, the ACTSF was given control of Building 5500 to house for artifact storage, including a newly renovated weapons vault. This vault did not include any of the required weapons racks or secured storage for the weapons. The number of weapons in the ACTSF’s collection combined with the size of the vault requires the use of a high-density storage system. Spacesaver systems are already used by the NIM-SC and most, if not all, other small arms rooms on Fort Moore, GA to include the 75th Ranger Regiment and the U.S. Army Marksmanship Unit. Patterson Pope Inc., as the sole authorized Spacesaver Area Contractor for the state of Georgia, has installed and serviced most if not all of these arms rooms.

c. Impact: As an U.S. Army organization, the ACTSF is required to meet physical security requirements in accordance with Army Regulation 190-11. Given the size of the ACTSF arms room, a Spacesaver high-density storage system will allow the safe and secure storage of all the Armor & Cavalry weapon’s collection while still being able to access the weapons to support training and education. Spacesaver systems have already been designed to meet all U.S. Army physical security requirements. Patterson Pope Inc.’s previous and current work on Fort Moore, GA, will simplify the design process and ensure that their products and services will meet the physical security standards since they are already familiar with the requirements. The use of Spacesaver systems will also simplify the movement of weapons between the ACTSF arms room and the NIM-SC arms room as there will be weapons rack component commonality. Both being organizations of the U.S. Army Center of Military History, the NIM-SC and ACTSF serve as back up arms rooms for each other in the case of natural disaster or maintenance needs that requires moving weapons out of one vault. As both collections have many unusual and unique weapons, arms rack commonality with modular systems like the Spacesaver racks helps ensure proper physical security and proper storage.

6. Efforts to Obtain Competition: Based on reasons cited in paragraph 5, competition for this action is not feasible at this time as any other arms room storage provider cannot provide a Spacesaver High Density Storage System that will meet the arms room space, weapons volume, and unique dimensions of the ACTSF’s weapons collection.

a. Effective Competition: For the reasons cited in paragraph 5 above, there is no effective competition anticipated for this acquisition as long as the exclusivity letter from Spacesaver Corporation CEO is in effect. The notices required by FAR 5.201 will be published.

b. Subcontracting Competition: Pursuant to FAR 19.702(b)(1), a small business subcontracting plan is not required since Patterson Pope Inc. is a small business.

7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above as there is no effective competition anticipated for this acquisition as long as the Spacesaver Corporation exclusivity letter restricting sole authority to Patterson Pope, Inc., to sell, service and install Spacesaver High Density Mobile Storage Systems in the state of Georgia is in effect.

Moreover, the non-Spacesaver products require custom design work and fabrication in order to fit the ACTSF’s need.

8. Market Research: Pursuant to FAR Part 10, Market Research was conducted via an internet search and other historical acquisition information on 19 Aril 2024. Market research indicates that there are numerous small and large business vendors throughout the country that are authorized dealers of arms room storage systems and/or Spacesaver Corporation products. All the Spacesaver businesses have exclusivity rights within their State or geographical region. Patterson Pope Inc. has exclusivity rights to all Spacesaver product installation, service, and maintenance in the state of Georgia. As a result, ACC-DTA intends to award this contract to Patterson Pope Inc. on a sole source basis in accordance with the terms and conditions of the Spacesaver Corporation Exclusivity Letter.

9. Interested Sources: For the reasons cited in paragraph 5 through 8 above, there is no effective competition anticipated for this acquisition as long as the exclusivity letter from Spacesaver Corporation CEO is in effect. Based on the Spacesaver exclusivity letter’s statement that any existing Spacesaver system must be worked on by only factory trained and certified Spacesaver installers in order to maintain warranty excludes any other interested sources from competing for this contract.
