About this file

This document is a Justification and Approval for Other than Full and Open Competition for a modification to increase the ceiling amount on three existing IDIQ contracts for Legislative Branch Financial Management Systems (LBFMS) services.

The Library of Congress has three IDIQ contracts, LCLOC19D0011, LCLOC19D0012, and LCLOC19D0013, for LBFMS hosting and support services. The ceiling amount on these contracts has been reached, so the Library is creating a class Justification and Approval to increase the shared ceiling amount by $542,591.49. The increased ceiling will support continued hosting, application management, help desk, upgrades, and other vital financial system services for the Library and legislative branch partners. The existing IDIQ contracts have a period of performance from 09/25/2019 to 09/24/2024, with a total contract ceiling of $90,000,000. The justification indicates a critical need to extend task orders to avoid a lapse in service. The contracting officer has determined the pricing is fair and reasonable based on comparison to historical prices and existing IDIQ labor rates.

Justification and Approval For Other than Full and Open Competition

Plan ID Number: 2024-CFO-0056

Form Updated 4/14/2023

Justification & Approval

As a legislative branch agency, the Library is subject to the competition and advertising requirements of 41 U.S.C. § 6101. Like the Competition in Contracting Act and the FAR, 41 U.S.C. § 6101 does not require competition when a contracting officer certifies that only one source or brand-name item is available, when dictated by public exigency, or when otherwise authorized by law.

This document sets forth the justification and approval for award of a contract or order by means providing for other than full and open competition per 41 U.S.C. § 6101, LCR 7-210, and, as applicable, FAR 6.302, FAR 13.106-1, FAR 8.405, and FAR 16.505. Contracting without competition shall not be justified on the basis of a lack of advance planning or concerns related to availability of funds.

This form shall be used to support instances where competition will be limited to a single source, a limited number of sources, including where a brand name product is required.

Part 1 – Identification

1. Contracting Agency and Activity: Library of Congress, Office of the Chief Operating Officer (OCOO)

Financial Services Directorate (FSD)

2. Nature of Action Being Approved

Contract (or modification) LoC or Leg Branch Order (or modification) GSA Schedule or GWAC Other: Modification to existing Multiple Award IDIQ:

LCLOC19D0011, LCLOC19D0012, and LCLOC190013

The Library currently has three IDIQ contracts for Legislative Branch Financial Management Systems (LBFMS). The ceiling amount has been reached on all the IDIQ contracts. Therefore, the Library is creating a class Justification and Approval to increase the shared ceiling amount. The shared ceiling amount for all IDIQ contracts will be increased by $542,591.49. The class Justification and Approval shall increase the shared ceiling amount on the following LBFMS IDIQ contracts:

1. CGI Federal Inc. LOCLC19D0011 12601 Fair Lakes Circle Fairfax, VA 22033-4902

2. Distributed Solutions, Inc. LOCLC19D0012

3. The MIL Corporation LCLOC19D0013 4000 Mitchellville Road Suite A210 Bowie, MD 20716

3. Description of Supplies or Services Required to Meet Library Needs

The Library requires the following supplies or services:

The Library of Congress (Library) and the Legislative branch partners have an ongoing need for a full range of services required to provide financial system hosting and support services to the Library and the legislative branch partners. This includes all services associated with system hosting, application management services, help desk support (tiers 1, 2, and 3), upgrades/migrations, enhancement/testing support, program management, IV&V support, system training, documentation and system study support, software licensing and maintenance, transaction processing and financial management support, and business process reengineering support. These services are vital to the Library and the Legislative branch in executing its financial systems and select financial services. The LBFMS consists of Momentum Financials Plus, Acquisitions Plus, Travel Accounting, Fixed Assets, Project Cost Accounting, Central Contracts File Connector, and Form and Content reporting. The system currently operates on Momentum version 7.8, with software upgrades scheduled for every 2 to 3 years.

A new replacement IDIQ contract (sole source) to CGI Federal Inc and a new multiple award IDIQ Help Desk contract for these services are being negotiated but has not been awarded yet. The existing IDIQ contracts are 09/25/2019 through 09/24/2024. The maximum aggregate amount of all task orders that can be issued under the LBFMS Hosting and Support services IDIQ is $90,000,000.00. The Library and Legislative branches have a requirement for continues support for their financial systems and hosting support cannot be left unsupported. The current ceiling has only $94,027.69 remaining with a critical Task Orders needing to be extended to stop a breach in service.
