JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Fire Protection and Emergency Medical Services
Fort Simcoe Job Corps Center
The following Justification For Other Than Full and Open Competition (JOFOC) is prepared in accordance with FAR 13.5:
1. Identification of Agency: USDA/USFS
2. Nature and/or Description of Action Being Approved:
The Fort Simcoe Job Corps Center (JCC) has an ongoing need for fire protection and Emergency Medical Services (EMS) for the Buildings and Structures at the Fort Simcoe JCC, located in White Swan, WA.
3. Description of Supplies or Services Required to Meet Agency’s Need Including Estimated the Value:
Fort Simcoe JCC requires fire protection and EMS services to cover the buildings and structures. These services are provided by the local fire department, Yakima Fire Protection District No. 5. The fire protection and EMS services includes firefighting, alarm response services, annual property assessments, and emergency medical services for the JCC.
The total estimated value for these services is .
4. Identification of Statutory Authority Permitting Other Than Full and Open Competition:
FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Demonstration That the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires use of the Authority Cited:
The Yakima Fire Protection District No. 5, is the local fire authority that provides fire protection and EMS services to the Fort Simco JCC. The Federal Government does not staff a fire department onsite and defers to the local fire authority for fire protection and EMS services. Yakima Fire Protection District No. 5 is the only source capable of providing fire protection and EMS services to the Fort Simcoe JCC.
6. A Description of Efforts Made to Ensure that Offers are Solicited From as Many Potential Sources as is Practicable, Including Whether a Notice was or Will be Publicized as Required by Subpart 5.2 and, if not, Which Exception Under 5.202 Applies:
The fire protection and EMS services are for the local Government authority, Yakama
Fire Protection District 5, to provide emergency assistance at Fort Simcoe JCC in the event of a fire or medical emergency. It is not feasible to compete these services based on this being a local Government function.
7. Determination by the Contracting Officer That the Anticipated Cost to the Government will be Fair and Reasonable:
The Contracting Officer determines that the anticipated cost to the Government will be fair and reasonable based on a comparison to historical prices paid for the same work.
8. Description of Market Research Conducted:
Market research was conducted by the Fort Simcoe JCC. Market research found that the Yakama Fire Protection District No. 5 is the only vendor capable of providing fire protection and EMS services to the Fort Simcoe JCC.
The Contracting Officer verified that no other Fire Protection Services are available at the Fort Simcoe JCC. The Washington State Fire Protection Districts are established by the State of Washington, through Public Law, Title 52 RCW – Fire Protection Districts, and specifically Chapter 52.26 RCW – Regional Fire Protection Service Authorities, and the Yakima Fire District No. 5 is the designated Fire District for Yakima County.
9. Any Other Facts Supporting the use of Other Than Full and Open Competition:
An Intent to Sole Source was posted on the Federal Business Opportunities (FBO) website on September 4, 2014, with a closing date of September 8, 2014, as required by FAR 6.302-1 (d)(2). No responses were received by the closing date and time.
This was for the original base plus 4 options, Yakima County Fire District 5 wasn’t in agreement to sign a base plus 4 option years, so an annual follow-on contract is established each year.
10. A listing of the Sources, if any, That Expressed, in Writing, an Interest in the Acquisition:
To date, no other sources have written to express an interest.
11. A Statement of the Actions, if any, the Agency may Take to Remove or Overcome any
Barriers to Competition Before any Subsequent Acquisition for the Supplies or Services Required:
The fire protection and EMS services are for the local Government authority, Yakama Fire Protection District 5, to provide emergency assistance at Fort Simcoe JCC in the event of a fire or medical emergency. It is not feasible to compete these services based on this being a local Government function.
