About this file
This is a Justification for an Exception to Fair Opportunity (J&A) document issued by the Department of the Navy's Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia, for Delivery Order N5054-26-F-2080 under IDIQ Contract N5054-25-D-0015.
The Navy is awarding dry-docking maintenance work on the YRBM(L)-28 barge as a sole-source delivery order to Colonna's Shipyard Inc. under a Firm-Fixed Price (FFP) contract. The work encompasses multiple tasks including accountability of manhour and material preservation, underwater hull inspection and repair, temporary service provision, cleaning and pumping operations, docking and undocking, and hazardous waste control. The justification cites urgency as the basis for the exception to fair opportunity, noting that water intrusion through the vessel's underwater hull requires immediate dry-docking to prevent further damage and identify all repair points. The Navy determined that providing fair opportunity through standard 30-day competitive procedures would result in unacceptable delays. Colonna's Shipyard possesses dedicated dry-docking facilities and can mobilize and complete the work faster than other contractors. The contracting officer will conduct cost or price analysis to ensure fair and reasonable pricing. The Government commits to competing future delivery orders under the Barge MAC IDIQ to the maximum extent practicable, with exceptions only when orders meet one of the six statutory exceptions outlined in FAR 16.505(b)(2)(i)(A)-(F). Continuous market research efforts are planned to maximize competition throughout the contract's period of performance.
