About this file
This is a Justification for an Exception to Fair Opportunity under an IDIQ contract issued by the Department of the Navy, Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia.
The justification authorizes a single-source procurement to BAYTEC Marine LLC for repair and maintenance work on the YRBM(L)-35 barge under contract N50054-25-D-0014, to be awarded as a firm-fixed-price delivery order. The work encompasses accountability of material and material reservation, heating and air conditioning (HVAC) installation, cleaning and pumping, and hazardous waste control for an estimated cost that is redacted. The exception to fair opportunity is justified under FAR 16.505(b)(2)(i)(A)—agency need for services of such urgency that providing fair opportunity would result in unacceptable delays. The barge requires urgent repairs while crew members are located aboard, and the operational schedule necessitates expedited procurement. On January 29, 2026, the Government requested information from four barge contractors; three declined to support the YRBM(L)-35 due to its location, while only BAYTEC indicated willingness to proceed. BAYTEC's personnel are already established in the area with base access, housing, and familiarity with the barge's location, eliminating travel delays from Connecticut. The contracting officer will determine cost reasonableness through cost or price analysis. The Government commits to competing all future delivery orders under the Barge MAC IDIQ to the maximum extent practicable, limiting exceptions to orders meeting FAR 16.505(b)(2)(i)(A) through (F), with continuous market research designed to maximize competition throughout the contract's performance period.

(5) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer will evaluate and determine whether the cost is fair and reasonable based on cost or price analysis.
(6) Any other facts supporting the justification.
On 29 January 2026, all four barge contractors were requested to answer a request for information for upcoming barge solicitations. Lyon Shipyard, East Coast Repair & Fabrication, and Colonna’s Shipyard all declined to support the YRBM(L)-35 due to its location. BAYTEC noted that their company would be open to support the YRBM(L)-35 since their personnel were already in the area supporting the active delivery order.
BAYTEC’s personnel are already established in the area, have base access, housing, and will not need to travel to Connecticut.
(7) A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
The Government intends to compete all delivery orders issued under the Barge MAC IDIQ to the maximum extent practicable. Exceptions will only be made for orders which meet one of the six exceptions in FAR 16.505-(b)(2)(i) (A) through (F). Continuous Market Research efforts performed by the Government are designed to continue maximizing opportunities for competition throughout the Period of Performance of the Barge MAC IDIQ.
