About this file
This is a Justification for an Exception to Fair Opportunity document issued by the Department of the Navy, Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia for a delivery order under an existing IDIQ contract.
The procurement restricts the source to BAYTEC Marine LLC for YR-29 vessel sustainment work valued at an estimated cost (redacted). The work encompasses multiple maintenance tasks including accountability of manpower and material reservation, hydrogen sulfide alarm system calibration and certification, fire and flooding alarm system inspection, refrigerant monitoring system calibration, HVAC servicing, Gaylord hood system inspection, habitability installation accomplishment, barge systems check-off list completion, and cleaning and pumping operations. The justification cites exception (A) under FAR 16.505(b)(2)(i)—urgency that would result in unacceptable delays if fair opportunity were provided. The Government determined that BAYTEC Marine LLC is the only available source capable of accepting the sustainment work during the YR-29's operational schedule. The vessel is scheduled to arrive in July 2025, and expedited procurement is essential to maintain crew habitability. BAYTEC's personnel are already positioned in the area supporting another barge, eliminating mobilization delays and travel costs associated with bringing in another contractor from Virginia to Connecticut. The Government intends to compete future delivery orders under the Barge MAC IDIQ to the maximum extent practicable, with exceptions only for orders meeting FAR 16.505(b)(2)(i) criteria. The contracting officer will conduct fair and reasonable cost analysis, and continuous market research efforts will be performed to maximize competition opportunities throughout the contract period.

Source Selection Information – See FAR 2.101 and 3.104 contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3). When setting aside orders for small business concerns, the specific small business program eligibility requirements identified in part 19 apply.
(5) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer will evaluate and determine whether the cost is fair and reasonable based on cost or price analysis.
(6) Any other facts supporting the justification.
Upon re-engagement BAYTEC noted that their company would be open to support the YR-29 since their personnel were already in the area supporting another barge.
BAYTEC’s personnel are already established in the area, have housing, and will not need to travel to Connecticut.
(7) A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
The Government intends to compete all delivery orders issued under the Barge MAC IDIQ to the maximum extent practicable. Exceptions will only be made for orders which meet one of the six exceptions in FAR 16.505-(b)(2)(i) (A) through (F). Continuous Market Research efforts performed by the Government are designed to continue maximizing opportunities for competition throughout the Period of Performance of the Barge MAC IDIQ.
