About this file

This is a Justification for an Exception to Fair Opportunity under an IDIQ contract, issued by the Department of the Navy's Mid-Atlantic Regional Maintenance Center (MARMC) in Norfolk, Virginia.

The justification supports awarding delivery order N50054-25-F-5315 to Bay Metals & Fabrication (BMF) on a sole-source, firm-fixed-price basis under parent contract N50054-25-D-0009. The work involves heating and air conditioning (HVAC) inspection, recharge, and repair for the YRBM(L)-27 barge to support FY25 sustainment operations. The estimated contract value and specific funding amount are redacted. The Navy cites urgent operational need as the exception basis under FAR 16.505(b)(2)(i)(A), asserting that fair opportunity procedures would result in unacceptable delays. The justification explains that the YRBM(L)-27 requires continuous HVAC support to maintain crew habitability while the vessel remains uninhabitable during scheduled maintenance. Multiple HVAC units require overhaul rather than minor repairs due to extended operational demands, and the Navy's operational requirements necessitate immediate service availability. The contracting officer will determine fair and reasonable pricing through cost or price analysis. The government commits to maximizing competition for future delivery orders under the Barge MAC IDIQ through continuous market research and will only use exceptions when meeting one of the six FAR 16.505(b)(2)(i) criteria.
