JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)

LIMITED SOURCES JUSTIFICATION

Upon the basis of the following justification, I, as Procuring Activity Competition Advocate, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 10 U.S.C. 2304c(b), Task and Delivery Order Contracts: Orders – Fair Opportunity Exceptions.

JUSTIFICATION

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requiring Agency:

Defense Information Systems Agency (DISA) Contracting Activity:

Defense Information Systems Agency (DISA)/

Defense Information Technology Contracting Organization (DITCO)

2300 East Drive, Bldg. 3600

Scott AFB, IL 62225-5406.

2. NATURE/DESCRIPTION OF ACTION(S): To procure a Microsoft Premier Services task order against the Microsoft Premier Support Contract, W91QUZ09D0038, to support DISA’s three networks: Integrated Distributed Information Support System/Nonsecure Internet Protocol Routed Network (IDISS) (NIPRNET), Secret Internet Protocol Router Network (SIPRNET) and Joint Worldwide Intelligence Communications System (JWICs). This contract will provide for two on-site engineers, a technical account manager, and Microsoft incident responses. Contract type will be Firm Fixed Price.

3. DESCRIPTION OF SUPPLIES/SERVICES: Services required is information technology contractor support required by DISA to provide instantaneous communications and support to the President of the United States, Vice President, First Lady and others as directed. Premier support provides account management from an assigned Technical Account Manager ("TAM") to build and maintain technical relationships with DISA’s key management and support staff and ensure each element of Premier Support meets DISA’s business requirements. Proactive services are required to help prevent problems and increase system availability. The technical support needed will provide DISA staff round-the-clock access to Microsoft support professionals for rapid resolution of complex problems. The account resources include a Technical Account Manager (TAM) assigned to function as a single point of contact to coordinate and deliver proactive, responsive, and online services to meet DISA needs. Also the Alliance Support Team (AST) is a group of designated support professionals who are familiar with the DISA environment and support needs. This team provides both proactive services and problem resolution services to ensure high levels of system availability and reliability. The estimated cost for this renewal is $1,440,952.22. The estimated period of performance is 01 October 2011 to 30 September 2012.

4. IDENTIFICATION OF STATUTORY AUTHORITY: Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. (FAR 16.505(b)(2)(i)(B)).

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: Microsoft is the only contractor who provides support for the already installed Microsoft Operating Systems and associated technologies that has the ability to reach into the Microsoft development team for fixes to these Operating Systems and technologies. They have the ability to reach inside of the Microsoft Corporation for resources and fix actions to their systems and applications. Microsoft does not give this capability to any of its partners or resellers; the employees have to be Microsoft employees in order to reach back into Microsoft. Microsoft has proprietary rights to all of their products and services. Microsoft is the only company that can provide direct support for their products and has the engineers needed to quickly resolve any issues with Microsoft products. Microsoft will not support products done by third party vendors. The ability to work directly with the source of the product is imperative for Presidential support. This is the only government contract available for direct purchase of Microsoft services. Market research and direct contact with Microsoft showed that they do not have a GSA Schedule in place for these services.

6. BEST VALUE DETERMINATION: Rates have been established within the basic contract. Proposed task order rates and loading will be compared with the basic contract rates and loadings and verified as fair and reasonable. The total estimated value for this requirement is $1,440,952.22.

7. MARKET RESEARCH: Market research was conducted via web and GSA schedules. It was determined that services will be provided through the Army Indefinite Delivery, Indefinite Quantity (IDIQ) contract for the required software maintenance. Research through resellers was analyzed, and it was found that third party vendors (resellers) cannot provide the service due to the fact that Microsoft will not support products/services provided by third party vendors.

Market research and direct contact with Microsoft showed that they do not have a GSA Schedule or any other contracting vehicle in place for these services.

8. ANY OTHER SUPPORTING FACTS. None.

9. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: DISA will continue to evaluate the ability of other companies to provide Microsoft specific assistance. As different companies are identified, DISA will reevaluate its choice of engineering service providers.

10. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP) PROGRAM PLAN (PP): Not required.
