THAN FULL AND OPEN COMPETITION
1. Contracting Agency: The U.S. Army Contracting Command – Warren (ACC- WRN) is the contracting activity responsible for this action.
2. Description of Action: The proposed contract action is to award a modification to the current Joint Light Tactical Vehicle (JLTV) contract (W56HZV-15-C-0095) with Oshkosh Defense, LLC (Oshkosh) to procure 3,509 JLTV Trailers (JLTV-T), thereby increasing the option quantity ceiling by 3,509 from 32 to 3,541. Joint Program Office (JPO) JLTV intends to exercise at award an initial quantity of JLTV-T production units estimated at 1,257 (Total FY20 quantity of 1,251 Army and 6 United States Air Force (USAF)). This action will be awarded on a Firm-Fixed-Price (FFP) basis utilizing FY20
- FY22 Other Procurement, Army (OPA), Procurement, Marine Corps (PMC) and USAF Procurement (PROC) funds.
3. Description of Supplies/Services: The purpose of this action is to provide the Army, USMC, and the USAF the ability to procure the below JLTV-T Production quantities allowing the JLTV and JLTV-T to be fielded as a system beginning in FY20.
JLTV-T Production: The manufacturing JLTV-T unit cost is based on an Oshkosh Rough Order Magnitude (ROM) estimated pricing for the JLTV-T.
Based on the Independent Government Cost Estimate (IGCE) developed by the JLTV Cost Team on 20 September 2019, historical and current projections, the total estimated FFP cost for this proposed contract is utilizing OPA, PMC, and USAF PROC funding. The total period of performance for this effort is three years
(FY20-FY22).
4. Authority Cited: The statutory authority permitting Other Than Full and Open Competition for this action is Title 10 United States Code Section 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii)(B), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Specifically, FAR 6.302- 1(a)(2)(ii)(B) provides that “supplies may be deemed to be available only from the
CMO Control No. 2020-008 month period of performance. Three JLTV EMD contracts were awarded under full and open competition. Tasks included design, development, modeling, simulation, fabrication, test, and test support of the next generation of JLTV vehicles. Contracts were awarded to:
i. W56HZV-12-C-0258 - AM General, LLC, South Bend, IN
ii. W56HZV-12-C-0262 - Lockheed Martin Corporation, Grand Prairie, TX
iii. W56HZV-12-C-0264 - Oshkosh Corporation, Oshkosh, WI
The current JLTV FoV contract was awarded on 25 August 2015 upon completion of a source selection limited to the three EMD phase contractors pursuant to Title 10 U.S.C Section 2304(c)(1), as implemented by FAR 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” The current contract includes three years of LRIP and approximately five years of FRP of JLTV’s, Trailers, and associated Kits. In addition, the current contract includes System Technical Support (STS), Interim Contractor Support (ICS), and Total Package Fielding (TPF). The contract was awarded to:
W56HZV-15-C-0095 - Oshkosh Corporation, Oshkosh, WI
2. The competitive status of the above actions were awarded under both full and open competition as well as limited competition.
3. The J&A for contract W56HZV-15-C-0095 is pursuant to Title 10 U.S.C Section 2304(c)(1), as implemented by FAR 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
4. The aforementioned JLTV TD and EMD contracts were awarded via full and open competition. The J&A supporting the current contract award provided the Government the ability to limit competition for the LRIP and FRP efforts to the three EMD contractors. In addition, the contract contained language sufficient to allow the Government to convert to a multiyear contract for the FRP effort, in accordance with FAR Part 17.
5. No unusual patterns were revealed by the procurement history.
6. The previous J&A for contract W56HZV-15-C-0095 was issued under the authority of FAR 6.302-1(a)(2)(ii)(A) and (B). The justification stated that it was cost prohibitive at that time to qualify a new contractor, as it would duplicate efforts that had already been performed under the JLTV EMD contracts and would result in both substantial duplication of cost and unacceptable delays in fulfilling the agency’s requirements. There have been no significant changes to those circumstances.
