About this file
This justification and approval document seeks to increase the ceiling on an existing electronic navigation charts contract by $750,000.00. The single award IDIQ contract was awarded to Geodesicx on November 8, 2019 with a ceiling value of $6,000,000.00 to supply electronic navigation charts and associated weekly updates required for the Military Sealift Command's Electronic Chart Display Information System on its ships. To date, delivery orders total $4,468,331.86 with $1,531,668.14 remaining on the ceiling. However, the final delivery order for charts needed by September 2023 is estimated to exceed the contractual ceiling by $750,000.00. The justification cites 41 U.S.C. 1901 and only Geodesicx as the responsible source can provide the charts by the required date, given insufficient time to compete a new contract prior to September 2023.

J&A No. N10220D0001
JUSTIFICATION AND APPROVAL (J&A)
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC), Norfolk, VA.
2. Description of the Action Being Approved: Modification of contract award N3220520D0001 with Geodesicx, to supply Electronic Navigation Charts (ENC) for MSC ships, to increase contract ceiling by $750,000.00. This increase is in support of an upcoming delivery order requirement estimated to exceed the current ceiling by and any potential variance as this amount is an estimate at this time.
Description of Supplies/Services: Single Award, IDIQ Supply Contract, N3220520D0001, was awarded to Geodesicx on 08 November 2019, and includes a four (4) year ordering period with a ceiling value of $6,000,000.00. The requirement procures ENCs and the associated weekly ENC updates and the weekly ENC permit updates, all of which are required for MSC’s Electronic Chart Display Information System (ECDIS). ECDIS is a geographic information system used for nautical navigation that complies with International Maritime Organization (IMO) regulations as a method of electronic navigation. ENCs are updated weekly, which provide critical changes as well as the routine addition of newly compiled data. The platform for purchasing ENCs is through a licensure system called “permits.” Permits are used to control the permissions required in order to use a chart. The National Geospatial Intelligence Agency (NGA), a combat support agency within the Department of Defense (DoD), charged with distributing geospatial intelligence in support of national security, is transitioning from Standard Nautical Charts (SNCs) to ENCs. MSC is undergoing the same process to convert all vessels to ENCs by FY25. To date, delivery orders have totaled $4,468,331.86 leaving $1,531,668.14 remaining on the $6,000,000.00 ceiling.
The final Delivery Order is estimated to be which will exceed the contractual ceiling by
3. Statutory Authority: 41 U.S.C.1901 as implemented by FAR 13.501(a)(ii), only one responsible source can satisfy agency requirements.
4. Rationale Justifying Use of Cited Statutory Authority: This requirement supports the use of the authority cited in 41 U.S.C. 1901. MSC has a requirement to purchase ENCs for MSC ships with a required effective date of . Geodesicx is the single award IDIQ holder and is the only available source under this contract that is able to provide the charts by the required date. There is insufficient time to award another contract prior to and MSC cannot go without ECDIS or Geodesicx services. MSC’s costs have likewise increased, and any reliance for fiscal support from NGA, as might be seen in normal operational environments, is no longer possible.
MSC’s N04 received the final list of charts required by each ship from the corresponding PM’s on 21 August 2023. Upon review of the list, N04 determined there was insufficient ceiling on the current contract to cover the upcoming delivery order requirement. The increase in MSC optempo and vessel security requirements have increased since the contract was awarded, and are a direct result of global events. MSC’s costs have likewise increased, and
