UNDER FAR 13.5, SIMPLIFIED PROCEDURES FOR
CERTAIN COMMERCIAL ITEMS
JUSTIFICATION
1. Contracting Activity

3. Description of Supplies/Services
The winch handling system (WHS) includes a winch module capable of raising and lowering a 2000 lb. payload with a safe working load of 10,000lbs aft of a ship and supports the towing of the device at 5 knots. The WHS includes the winch frame, winch drum, and powered drum rotation system. The WHS also includes a levelwind which is critical to force the cable back onto the reel in a uniform manner. The WHS includes a slip ring capable of supporting the government power and data signal requirements.
The slip ring is critical to allow the system to operate while the winch is rotating. The WHS is capable of fastening to ship deck in a variety of manners. The WHS supports a cable diameter of 1.22 inches as required for the government specified system.
The WHS is powered by 460 VAC, 3-phase power, 60 Hz, Delta configured, shipboard electrical power that is provided by the government designed power distribution system. The WHS power input connectors are commercial off the shelf (COTS) products as specified by government to connect to the power distribution system. The WHS has a means of displaying health status of the system while lifting and towing. The WHS is over-the-road transportable without the need for additional permits, e.g. does not require wide load transportation. The WHS also weighs no more than 15,000 lbs. The WHS has fork truck lifting points rated for the full WHS weight. The WHS also has lifting eyes rated to crane on/off the WHS onto a marine vessel as required for operations.

5. Rationale Justifying Use of Cited Statutory Authority
NUWCDIVNPT Code 34 is requesting a Sole Source contract for a hardware procurement of the MacArtney Inc. Winch Handling system to be compatible with existing items/systems already being used in support of the code 34’s mission.
The MacArtney model hardware is the only hardware that is built to the government’s design specifications. Any other hardware would require extensive new design, integration, system demonstration, and a complete technical documentation package. There is no other form, fit function replacement for this item. This would cost the Navy up to to develop a new system. In addition, an schedule slip would be incurred. Therefore, there is cost and time savings for the government by purchasing this item from MacArtney. This purchase will provide the fastest path to test demonstration and allow to concentrate on delivering these capabilities to the fleet.
In an email dated 28 May 2024, MacArtney confirmed that the items being purchased for this requirement are manufactured by and only sold directly by MacArtney.
Based on the above, it is not reasonable to conclude the potential savings from competition can offset the duplicative cost and schedule/mission impact associated with purchasing a new brand name product. Therefore, it is in the best interest of the government to solicit this requirement on a brand name only basis.

6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
A market survey was done by doing Internet searches and reaching out to all identified vendors who could possibly provide the highly unique enclosure. No other vendors responded as they didn’t wish to customize their existing systems or didn’t have the bandwidth to take on new work.
7. Determination of Fair and Reasonable Costs
The contracting officer will conduct price analysis using FAR 13.106-3 and or 15.404-1(b) and 15.404-1(c) methods, in accordance with FAR 13.003(g)(2) to determine proposed prices are fair and reasonable.
8. Actions to Remove Barriers to Competition Plan is to continue to perform market surveys to identify potential new sources that could provide the desired system. As this is a unique system, the penitential list of providers is limited. The government could also evaluate if expenditure of time and money warrants the significant government design effort to create build-to-print drawings of a similar system and balance that investment cost for a limited number of systems required.
