About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition under FAR Part 6 for a follow-on requirement for medical logistics authoritative data exchange and database subscription services.
The Defense Health Agency (DHA) requires these services to support various medical logistics lines of business, including equipment management, inventory management, purchasing, and patient safety. The requirement will be awarded as a sole source contract to ECRI, the incumbent provider, as they are the only vendor capable of meeting the government's need for real-time, authoritative data to support the DHA's medical logistics systems. The contract will be a firm-fixed-price award using FY 2024 operations and maintenance funds, with a fair and reasonable determination made through price analysis. The anticipated award amount is $2,936,038.57. There were no other acceptable sources identified through market research.

Justification and Approval for Other than Full and Open Competition – FAR Part 6
1. Contracting Activity: U.S. Army Medical Research Acquisition Activity (USAMRAA), 808 Schreider Street, Fort Detrick, MD, 21702.
2. Description of Action: The Defense Health Agency (DHA) Medical Logistics (MEDLOG) has a follow-on requirement for medical logistics authoritative data exchange and database subscription services. DHA requests a firm fixed price award using fiscal year 2024 operation and maintenance funds.
3. Description of Supplies/Services: The Department of Defense (DoD) Medical Logistics Community supports diverse Lines of Business (LOBs) to include equipment property and bio-medical maintenance management; pharmaceuticals and medical surgical inventory management; purchasing and quality assurance, patient safety; and assemblage and facilities management. The primary information systems supporting these LOBs are the Defense Medical Logistics Standard Support (DMLSS) system and the Theater Enterprise-Wide Logistics System (TEWLS). Over the last 20 years, these 2 systems have inherited as-built data that has been incorporated and merged data in different formats from different legacy applications to include Army, Navy and Air Force logistics and property legacy applications. As a result of these historical data merges, the 2 aforementioned systems contain data variance and data diversion. The lack of authoritative source data has impeded effective decision analysis and constrained optimized business processes which has an overall negative effect on our ability to support the various LOBs.
The DHA and Medical Logistics Information Technology Program Management Office have initiated a major technical refresh that will merge both the programmatic and technical components of all existing Defense MEDLOG applications, DMLSS, TEWLS and Joint Medical Asset Repository into a single program.
The award will be for a medical logistics authoritative data exchange and database subscription services supporting patient safety programs and medical logistics data standardization across DHA Military Treatment Facilities worldwide. This subscription service will provide authoritative, real-time data for hazard alerts and recalls for medical equipment and supplies, capital market analytics, data standardization, this capability allows ECRI to obtain salient and authoritative information direct from the equipment manufacturers to include
. Additionally, as stated earlier in the J&A document, a third-party vendor may “purchase” the authoritative data from ECRI in order to provide the subscription data to MEDLOG, however, the introduction of a third party would result in schedule delays, data transfer delays and the possibility of quality issues, which would not meet the need of real-time data, posing a risk to patient safety. If a third-party vendor is awarded the contract, the current DMLSS system would require modification and testing for the new vendor to access to the business-to-business gateway which, would result in a minimum delay of 6–8 months of real-time data.
Market research through the totality of the above listed methods suggests that no other sources exist in the marketplace that can execute this requirement with real-time data therefore, the Government will award a sole source contract to ECRI for the Medical Logistics Authoritative Data Exchange and Database Subscription Services.
9. Interested Sources: As stated earlier in the J&A, there were 6 responses to the sources sought notice posted on 25 April 2024. See Section 8 for details. A notice of intent was then posted to the SAM.gov on 25 June 2024 for 15 days and no further responses were received.
10. Other Facts:
a. Procurement history.
(1) Contract numbers and dates of all awarded contracts for these same requirements. N62645-19-P-0077 with an award amount of was awarded to ECRI with a period of performance of 30 September 2019 through 29 September 2024.
(2) The competitive status of these actions. The previous requirement was awarded as a sole source to ECRI. The redacted J&A for the previous contract, N62645-19- P-0077, was approved on 24 September 2019 and is located in this contract file. The previous J&A stated, “Future requirements will be synopsized in accordance with FAR 5.203. For the reasons set forth in Paragraph 5, Naval Medical Logistics Command has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, (NMLC) will assess whether competition for future requirements is feasible.”.
(3) Authority previously cited if less than full and open competition was used. The authority used on the previous award was 41 U.S.C. 1901 and FAR 13.106-1(b)(2) and 13.501(a).
(4) If a justification was prepared to support the procurement made before this one, a summary of the contents of paragraph 7 of the justification for that procurement and an explanation of the results. In the previous requirement, the paragraph discussing description of efforts to solicit offers from as many offerors as practicable included the following: “A Notice of Intent to Sole Source was posted to FedBizOpps 3 July 2019. To date, no other sources have written to express an interest.”.
(5) If any prior contract for this requirement was accomplished using full and open competition, include a detailed explanation of the changed circumstances causing this action to now limit the sources. Not Applicable.
(6) An explanation of any unusual patterns that may be revealed by the history, e.g., several consecutive, urgent buys. Not Applicable
(7) If a justification was prepared to support the procurement made before this one, briefly describe the circumstances justifying the procurement and whether there have been any significant changes. The J&A used to award the current award identified ECRI as the only company that provides independent analysis of medical devices and technology, which is compiled, updated, and made available in real-time through an online subscription-based portal. Additionally, ECRI is the sole vendor able to provide the medical logistics authoritative data exchange services required in accordance with DoDI 8320.02, utilized by the DMLSS program, the Accountable Property System of Record of accountable property and medical equipment maintenance for the Air Force, Army, Navy, and DHA.
