SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR
CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FEDERAL ACQUISITION
REGULATION (FAR) 13.5
On the basis of the following justification, I, as the Contracting Officer, hereby approve the use of a sole source proposed contractual action pursuant to the authority of 41 USC 1901 (a)1.
1. Identification of the agency and contracting activity, and specific identification of the document as a “Sole Source Justification Under Simplified Procedures for Certain Commercial Items (FAR Subpart 13.5)”
The Strategic Acquisition Center - Frederick (SAC-F), on behalf of the Department of Veterans Affairs (VA), Office of Information Technology (OI&T), Hines Information Technology Center (HITC), proposes to enter into a sole source contract with Brothers Lutron Services Co., Inc. (Lutron), a large business, under simplified acquisition procedures.
2. The nature and/or description of the action being approved, i.e., sole source under procedures for certain commercial items in accordance with FAR 13.5.
This activity proposes to negotiate a non-competitive, firm-fixed price award (sole-source) with Lutron to procure the software program, Lutron Quantum Vue, a commercial item/service. Quantum is a facility management solution that creates a flexible, productive, and energy-efficient environment for an entire building or campus. A single system provides dimming, switching, motorized shade control, system integration and energy management. It is used to manage the electric and natural light in multiple spaces using both automatic and manual control options.
3. A description of the supplies and/or services required, including the delivery schedule and/or the period of performance (inclusive of all option periods), and the estimated dollar value of the acquisition.
This software monitors the entire energy consumption within the HITC building and allows to fine tune all energy consumers (lights, Heating Ventilation Air Conditioning (HVAC) units, etc.). This software alerts & alarms, detects, and warns managers via email of any problems with the lighting system before they interrupt occupants. Lutron Quantum Vue is a web based application accessible via service, computer, laptop, tablet or smart phone. It has a dynamic tile interface- intuitive software interaction compatible with Windows Server 2012 “Savings by Strategy” Energy Report- quick glance on how much energy you’re saving by lighting control strategy.
The estimated value for this acquisition is $48,390.00 (including the base period and four option periods), and the anticipated performance period for the awarded contract is September 30, 2022, through September 29, 2023.
4. The statutory authority permitting sole source.
The authority is in accordance with FAR 13.501(a)(1)(ii).
The statutory authority permitting other than full and open competition is 41 USC 1901(a)(1) as implemented by FAR 13.106(b)(1).
5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.
The HITC currently has the Lutron Quantum Vue lighting control software system, and a required upgrade to the software is needed. The upgrade to the lighting system will keep the system free of bugs and security vulnerabilities for the life of the contract. This program monitors the entire energy lighting consumption within the HITC and allows users to fine tune the lighting parameters (lights and settings). This software adjusts the lighting to conform to the Occupational Safety and Health Administration (OSHA) requirements; load sheds to conform to energy savings requirements, and maintains the energy consumption reports that are reported on a monthly basis. Lutron has the institutional knowledge that cannot be replicated, as it is Lutron’s software, and their technicians are trained representatives able to service the equipment. Furthermore, they are the manufacturer of the lighting system, there are no other companies that are authorized to contract and deliver services for Lutron products.
6. A description of efforts made to ensure offers/quotes are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized in FEDBIZOPPS (as required by FAR 5.2) and, if not, which exception under 5.202 applies.
The Notice of Intent to a sole source was published on SAM.gov, and vendors were given ten days to respond to this notice, no responses were received. This justification and approval will be published to SAM.gov no later than 14 days after the award.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the contracting officer that the anticipated cost to the government will be fair and reasonable.
The anticipated dollar value of this requirement is $9,678.00 for the base period, and for the four options periods is:
Option One: $9,678.00 Option two: $9,678.00 Option three: $9,678.00 Option Four: $9,678.00
TOTAL: $48,390.00
The contracting officer will make a fair and reasonable price for the subject award.
Discounts will also be sought for this proposed procurement.

8. A description of the market research conducted and the results or the reason market research was not conducted.
A Vendor Information Pages (VIP) search was conducted using the keyword “Lutron” and zero (0) results appeared. Market research was also conducted by a General Services Administration (GSA) eLibray search, using the NAICS code 511210 which yielded 79 Service-Disabled Veteran-Owned Small Businesses (SDVOSBs). A Request for Information (RFI) was posted to GSA under this Special Item Number (SIN) on March 28, 2022, and sent to 38 SDVOSB vendors. The RFI closed on April 01, 2022, and no responses were received. A Request for Information (RFI) was also posted to NASA SEWP under this SIN on April 01, 2022, and sent to 35 SDVOSB vendors. The RFI closed on April 07, 2022, and no responses were received. As mentioned above, zero (0) results appeared on the VIP search, and no SDVOSB responses were received as a result of the RFI on GSA eBuy, nor NASA SEWP.
Lutron is able to provide the required lighting software. Based on the above information, it is recommended to proceed with a sole source purchase order to Lutron for the lighting.
9. Any other facts supporting the use of sole source.
Lutron is familiar with the existing HITC Lutron lighting software and is uniquely qualified to provide the upgrade/services.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
Lutron Services Co., Inc.
7200 Suter RD Coopersburg, Pennsylvania 18036-1249
11. A statement of any actions the agency will take to remove or overcome any future barriers to competition.
After the period of performance has expired and all options are exercised under the contract, it is expected that the re-compete will be competitively awarded, should market research again determine otherwise.
