The previous contract, 36C10X21P0034, was awarded at a fair and reasonable price, the contracting officer will make a fair and reasonable price for the subject award.
Discounts will also be sought for this proposed procurement.
8. A description of the market research conducted and the results or the reason market research was not conducted.
The contract specialist conducted market research through System for Award Management (SAM), VetBiz, and through reviewing an identical requirement, 36C10X21P0034. Market research showed other providers in Missouri; however, since utility services are highly regulated in Missouri, current regulations prohibit a power provider from providing power to a site currently serviced by another provider. A call to New Mac Electric Cooperative, another provider who services the Neosho, MO area, confirmed current regulations prohibit New Mac from supplying power for a site currently serviced by the Empire District Electric Company.
9. Any other facts supporting the use of sole source.
Received an email justification from the customer stating that Empire District Electric Company is the only electric provider that can service RCV in Neosho, MO. Missouri is not a de-regulated state for utilities. Each utility has a service territory. The RCV is within their service territory, so therefore the Empire District Electric Company would be the only option for an electricity provider.

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition.
Program reached out to another power company that provides power to the Neosho, MO area. The other company informed the program office that since Empire District Electric Company is the current provider, Missouri Regulations prohibit another company from providing the same services to RCV. Program and the contracts office will continue to check to see if the current regulation continues to prevent another company from providing services to RCV.
