JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. Agency and Contracting Activity.

This Justification and Approval is to request authority for Other Than Full and Open

Competition supporting requirements generated for AFLCMC/WIUAB. The contracting activity for this requirement is AFLCMC/WIUKA. The Purchase Request supporting this contracting action is FD2060-22-30066.

II. Nature and/or description of the action being approved.

Due to the circumstances described herein, the activity requests authority to acquire Contractor-

Inventory Control Point (C-ICP) in support of the MC-130 Air Refueling System (MCARS) using Other Than Full and Open Competition as prescribed by 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. This action will result in the award of a follow-on contract, which will be a definite “C” contract with a 12 month basic period plus one annual option period. The period of performance (PoP) is projected to be 31 Dec

2021 through 30 December 2023 unless the option to extend services is exercised which will extend the contract through 30 June 2024.

III. Description of the supplies/services required to meet agency needs (including the estimated value).

This requirement is for C-ICP in support of MCARs. The support includes material management services in support of (MCARS applicable to the Air Force Special Operations Command

(AFSOC) MC-130H Combat Talon II aircraft.

Total estimated contract value is . The basis for the estimated cost was derived from

Program Office review of the yearly expenditures of each CLIN in the current MCARS CLS

Contract.

Under the contemplated contract, Boeing will provide the following services:

a. Accomplish material management tasks for MCARS-unique components using Contractor

Supported Weapons System tenets. This will require Boeing, to be an Air Force Material

Command (AFMC) certified C-ICP. Boeing will be required to provide full asset visibility in

Government legacy systems of all MCARS unique components. Boeing’s responsibilities will include operation/management/control of stored inventories, distribution, and administration of

C-ICP material requirements.

IV. Statutory authority permitting other than full and open competition.

10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1 - 10 USC 2304(c)(2), Only one responsible source and no other supplies or services will satisfy agency requirements.

V. Demonstration that the contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited above (applicability of authority).

The agency's minimum needs can only be satisfied by the unique services available from Boeing.

They are currently providing C-ICP support for the MCARS program, and they are the only company that is certified to do so. Any attempt for another entity to acquire certification to become an MCARS C-ICP would require a minimum of six months, leaving the program without sufficient material issue and storage support.

The MC-130H aircrafts are retiring in 2023 along with the MCARS system. Since the MCARS system will only require support for 2 years, there is no time to receive any return on investment through a new source of C-ICP. Any attempt to find a new entity for C-ICP services would result in unneeded duplication in costs and would cause a gap in support for the MCARS program.

Accordingly, Boeing is the only firm capable of providing the requirements described in Section

III above without the U.S. Air Force experiencing substantial duplication of cost that could not expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under FAR 5.202 applies.

A Request for Information (RFI) was posted to beta.SAM on 13 April 2021 with a response date of 13 May 2021 under solicitation number FA8509-21-R-0022. The RFI requested responses from interested vendors that possess the expertise, capabilities, and experience to meet qualification requirements for this effort. One vendor responded to the RFI. The vendor was evaluated for their capability and was determined to be satisfactory based on program requirements.

VII. Determination by the Contracting Officer that the anticipated cost to the

Government will be fair and reasonable.

The overall cost of this acquisition will be fair and reasonable to the Government. Since this effort does not exceed , the Contracting Officer’s certification required by FAR 6.303-

2(b)(12) will serve as approval.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research was conducted during 1 Feb through 13 May in accordance with FAR Part

10.001 and 10.002. The market research techniques used are as follows:

As described in Section VI above, a RFI was posted to beta.SAM advising industry of the pending acquisition and soliciting inquiries from interested vendors. The RFI was posted on 13

Apr 2021 under Solicitation Number FA8509-21-R-0022. Only Boeing responded to the RFI.

Boeing was evaluated for its capability and was determined to be capable based on project requirements.

Queries were conducted on the item description in search of potential sources within

Government data bases and through the search engine Google. Searches were conducted using

NAICS 336413 and keywords “Mid-Air Refueling Contractor-Inventory Control Point” and

“Mid-Air Refueling C-ICP.” The searches revealed one company, Boeing. Which is the current

C-ICP provider for the MCARS program.

The market research concluded Boeing is the only vendor capable of fulfilling the Government’s requirement.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

None.

X. List of any sources that expressed, in writing, an interest in the acquisition.

See Section VI above.

XI. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition Before Making Subsequent Acquisitions for the Supplies or

Services Required.

Due to the drawdown of the MC-130H platform in 2023 and the six to nine month time frame needed to setup a certified MCARS C-ICP, there is limited time for the Government to reduce the barriers to competition for the MCARS C-ICP. Any attempt to utilize another entity for C-

ICP could result in a gap in coverage for the Government and would provide an unneeded and substantial duplication of costs.
