JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY
United States Air Force AFSC/PZA 3001 Staff Drive Tinker AFB, OK 73145
Purchase Request (PR): FD2030-19-00638
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
This individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a new non-commercial firm-fixed-price, requirements type repair contract. This is not a Bridge Action. The contemplated new repair contract is for repair service of the Power Amplifier AN/GRN-31, NSN 6605-01-619-9660 P/N 030003-001 and the Power Amplifier AN/GRN-31, NSN 6605-01-622-1748 P/N 030004-001 from Selex Incorporated, Commercial and Government Entity (CAGE) code 64415. A one-year basic and four one-year options is considered appropriate for this acquisition. This contract will include the Option to Extend Services clause (FAR 52.217-8). The total estimated value of this contemplated contract is with an estimated award date of January 2021.

AGENCY’S NEEDS
Under the contemplated contract, Selex Inc. will provide the following repair services of the ATCALS Power Amplifier AN/GRN-31.

Repair of NSN: 6605-01-619-9660IM P/N: 030003-0001 Noun: Power Amplifier AN/GRN-31 Application: ATCALS Item description and function: AN/GRN-31 Power Amplifier (1A22/1A23/1A24/1A25) amplify the Course and Clearance RF signals from the Synthesizer Assembly (1A2/1A14) to the level necessary for radiation by the antenna. In addition, the SBO and CSB signals are modulated in this assembly. Provides final course line information to landing aircraft. This information is received by the aircraft and is displayed as a visual indication enabling the pilot to maintain the proper course until visual contact is made with the runway and the landing is completed.

Due to the circumstances described below in Sections V, IX and XI, there are no immediate actions that could be taken to develop competition. Therefore, it is considered appropriate to seek approval for more than one fiscal year. If other qualified or approved sources become known during the life of this contract, full and open competition will be considered and utilized to the maximum extent practicable.

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(iii).
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE
QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE
USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF
AUTHORITY)
This acquisition will be for a new repair contract that will provide continued repair services for the Power Amplifier AN/GRN-31, NSN 6605-01-619-9660 P/N 030003-001 and the Power Amplifier AN/GRN-31, NSN 6605-01-622-1748 P/N 030004-001. The Power Amplifier amplifies the Course and Clearance RF signals from the Synthesizer Assembly (1A2/1A14) to the level necessary for radiation by the antenna. Therefore, this acquisition will be a direct contract with Selex Inc., the Original Equipment Manufacturer (OEM) for repair of this highly specialized service.

The government realizes that it has unlimited rights to form, fit and function data, as well as data related to operation, maintenance, installation, and training, however, such rights are insufficient to develop repair specifications. Further, there are no Technical Orders that detail repair procedures.
Accordingly, Selex, Inc. is the only firm capable of providing the repair described in Section III above without the Air Force experiencing substantial duplication of cost that is not expected to be recovered through competition and unacceptable delays in fulfilling its requirements.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED
PRACTICABLE
In an effort to identify additional sources, a Source Sought Synopsis (SSS) was posted to Federal Business Opportunities (FedBizOpps) under solicitation number FD2030-19- 00638 on 25 July 2019, with a closing date of 26 August 2019. Blue Ice Engineering LLC. Cage Code 81H52 responded. The response did not address any of the technical questions as required by the SSS, and no source approval package has been submitted.
Blue Ice Engineering remains unqualified to perform this work. To date, Selex Inc. is the only approved source for this repair.
In accordance with FAR 5.201, this requirement shall be synopsized and the Request for Proposal (RFP) will be posted to the FedBizOpps website. The estimated date of publication is December 2019. Consideration of the capability shall be given to any identified, potential sources prior to award.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE
The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor will be required to provide certified cost and pricing data. A detailed cost analysis and price analysis will be accomplished. The Defense Contracting Management Agency and/or Defense Contract Audit Agency will be contacted to assist with the analysis, and may assist with inputs throughout the life of the contract.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH
WAS NOT CONDUCTED
Market research, in accordance with Far Part 10, was conducted by the multi-functional team consisting of the Logistics Management Specialist, Engineer, Production Management Specialist and Procuring Contracting Officer. The conducted research consisted of internet searches, reviews of government databases, reviewed results of recent market research on similar requirements and a Sources Sought Synopsis posting.
The market research revealed that there is not a commercial process available to meet this requirement. Market research also allowed the Government team to identify the same sole-source market condition that has existed since these parts originally were manufactured by the OEM. Selex Inc. was found to be the only source available able to fulfill the requirement.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE
MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES
REQUIRED
As a result of continued refusal by the Sole Source contractor to provide or license data as well as the duplication of cost and unacceptable delay of developing additional sources per Sections V and IX, there are no known additional actions which can be taken to remove barriers to competition and therefore, specific actions and milestones cannot be established.
Per DFARS PGI 206.304 (a) (S-70) - As indicated by signature on the Coordination and Approval Document, the previous J&A has been reviewed and the Approval Authority determines that and all stated actions to remove barriers to competition have been accomplished.
XII. CONTRACTING OFFICER’S CERTIFICATION
The Contracting Officer’s signature on the coordination and approval document evidences the Contracting Officer has determined this document to be both accurate and complete to the best of the Contracting Officer’s knowledge and belief.
XIII. CERTIFICATION BY THE TECHNICAL/REQUIREMENTS PERSONNEL
By their signatures on the coordination and approval document, the technical and/or requirements personnel have certified as accurate and complete all supporting data, which is their responsibility, contained herein IAW FAR 6.303-2(c).
